Spese ripetibili sono le spese che possono essere per legge pretese indietro da colui nel cui interesse sono effettuate, non ripetibili sono quelle spese per cui la legge non prevede la "ripetibilità", cioè il diritto di farsene rimborsare, ma in questo caso vengono evidentemente richieste comunque.
