Japanese to English Law/Patents Finance (general) Security / collateral
I am wondering how to translate 転抵当 into English. It is designed to take security over existing security for collateral purposes. FYI, 転抵当=抵当権者が抵当権を自己の債務の担保とすること according to a law dictionary. Many thanks! よろしくお願いします。

Rehypothecation

Japanese Civil Law §376 I, 1st half (抵当権者がその抵当権をもって自己または他人の債権の担保とすること) is basically “rehypothecation (re-hypothecation).”

When broker-dealers use securities that have been posted as collateral by their clients such as hedge funds to back the broker's own trades and borrowing, they are practicing rehypothecation. It is so utilized by these people that we might forget what it was originally.

This is what I can think of as the 転抵当. Wikipedia discusses also “rehypothecation in repo agreements.
