Aanpassing van de tweede zin van artikel 1 van de statuten in die zin dat “naamloze vennootschap die een publiek beroep doet of heeft gedaan op het spaarwezen” geschrapt en vervangen wordt door “naamloze vennootschap die een openbaar beroep doet of heeft gedaan op het spaarwezen”.

I presume that this is a Belgian document, so in this context "spaarwezen" refers to a public offer / offering of securities in a private company.
From Eurodicautom:
"a transaction in which either a large block of existing securities previously held in private hands is offered to the public or the public is invited to subscribe to a issue of new securities ".

As for 'openbaar' and 'publiek', there is no difference and any purported difference would merely be an artificial one. It sounds more like an exercise in linguistic purification than a matter of legal detail. No doubt the lawyers didn't have much work on when they decided this change was required...
You could perhaps try and capture this "distinction" with 'public' vs. 'open'.
