Il trustee ha la "facoltà", il "potere", la "discrezionalità" di investimento, mai l'obbligo, in quanto i beni posti in trust dal Disponente rientrano nella piena disponibilità del Trustee.
Ecco perché, a mio avviso, per "any monies requiring to be invested", si intende che i denari che il Trustee intende investire (a sua assoluta discrezione) "debbano" (qui esiste l'obbligo) essere investiti nell'acquisto di beni mobili e immobili. Pertanto non si intende "per cui vi sia l'obbligo"...

certo hai ragione su "may" nel senso che possono, ho letto in fretta e mi era sfuggito!
confermo invece la mia resa "i denari da investirsi ai sensi del trust di cui a questo strumento (hereof) possono...."
a me sembra più scorrevole

| Salve Marilina, ragionavo sulla tua proposta e "da investirsi" vuol dire in altre parole "che devono essere investiti" quindi il senso è lo stesso dell'obbligo. Inoltre quando dici "debbano (qui esiste l'obbligo)" secondo me non è un obbligo perché nel testo in inglese dice "may be invested". |
