What is a reliance letter?

A reliance letter is a letter from one party to another party allowing them to rely on the contents of a report.

In construction and engineering projects this often relates to a letter from an environmental or geotechnical consultant allowing someone interested in a site or a development to rely on the contents of site report(s) and/or survey(s).

Reliance letters can be offered by consultants (usually an environmental consultant) in place of a formal collateral warranty to the consultant's appointment. An environmental consultant, for example, may have investigated a site and produced a report that the developer wants to include as part of the employer's requirements. The contractor would want to be able to rely on the report and therefore needs to establish a relationship (and a cause of action should it be necessary at a later date) with the consultant.
