Under that Regulation the imposition of fines is in the first place subject to a ***limitation period*** (1) of five years although this can be extended. Time runs from the date of the infringement, and in the case of a continuing or repeated infringement, from the date the infringement ceases. The ***limitation period*** (2) may be interrupted by any action taken by the Commission to investigate any party to the suspected infringement. Each action by the Commission starts time running afresh. The arguments of these undertakings overlook the express provisions of the Regulation. They fail to appreciate that the first actions taken by the Commission to investigate the suspected cartel on 21 November 1983 interrupted the ***limitation period*** (3) for all participants in the suspected infringement, not just the particular producers visited at the time. The result is that only undertakings which had ceased to participate in any infringement before November 1978 could possibly benefit from the Regulation. Since the infringement alleged only commenced in 1980, the undertakings cannot invoke ***limitation*** (4) in this case.

Según lo establecido en dicho Reglamento, la imposición de multas está sujeta en primer lugar a un ***plazo de prescripción de cinco años*** (1), aunque este plazo puede ser prolongado. El plazo comienza a contar a partir de la fecha en que se ha cometido la infracción y, en caso de que ésta sea continuada, a partir de la fecha en que haya finalizado. Los ***plazos de prescripción*** (2) pueden quedar interrumpidos por una acción emprendida por la Comisión encaminada a investigar a cualquiera de las partes que intervengan en el acuerdo sospechoso. Cada acción de la Comisión hace que el plazo se reanude a partir de cero. Los argumentos de estas empresas pasan por alto las disposiciones expresas del Reglamento. En efecto, no se tiene en cuenta que las primeras medidas adoptadas por la Comisión para investigar el supuesto cartel el 21 de noviembre de 1983 interrumpieron el ***plazo de prescripción*** (3) de que pudieran disfrutar todos los autores de la supuesta infracción y no sólo las empresas inspeccionadas en aquel momento. Como resultado de ello, tan solo las empresas que hubieran dejado de participar en la infracción antes de noviembre de 1978 podrían acogerse a lo dispuesto en dicho Reglamento. Dado que la supuesta infracción comenzó en 1980, las empresas no pueden invocar esta ***prescripción.*** (4)

Cabe agregar que el plazo de prescripción para que se puedan iniciar acciones judiciales se computa a partir de la fecha de egreso
