Spanish term or phrase: sin mensurar
This phrase occurs repeatedly within an Escritura detailing various mining rights and activities. An example of the sentence in which it is found is: "....inscripta en el protocolo de Minas, No 01, bajo el No. 04, folio no 23/45, sin mensurar, con su canon minero eximido a la fecha.........." The country is Argentina.

From the latin, it seems be be something to do with measurement, but this doesn´t make much sense here. It looks like a stock legal phrase relevant to this sort of text and industry sector, but as yet I have not be able to track down a satisfactory explanation. Does anyone know what this is?

Explanation:
"Mensurar" means "medir": no two ways about it.

"Sin mensurar" refers to land, in this case, apparently, a mining plot. It doesn't necessarily mean that no one has ever measured it, literally. Here, for example, is an offer to sell land "sin mensurar" giving measurements:

"vendo lote de 20x40 sin mensurar a 1500 de las termas de san jose"

What it means is that it has never been officially measured by the authorities. In effect, it really means "unregistered". The measurement concerned is comparable with the Spanish "catastro", the land registry. Here is an example concerning illegally occupied land:

"la realidad es que hay familias que están dispuestos a pagar los impuestos, a realizar la mensura, y obviamente a acceder a los servicios básicos, así que con esto podrán disponer de su espacio legalmente".

So "unregistered" would be a possible, though free, translation. However, I think the literal "unmeasured" should be used. "Unmeasured land" is a recognised legal concept in English.
