(officially) unmeasured / unregistered Explanation: "Mensurar" means "medir": no two ways about it. "Sin mensurar" refers to land, in this case, apparently, a mining plot. It doesn't necessarily mean that no one has ever measured it, literally. Here, for example, is an offer to sell land "sin mensurar" giving measurements: "vendo lote de 20x40 sin mensurar a 1500 de las termas de san jose" http://venta-terrenos.vivavisos.com.ar/terrenos-campos-quint... What it means is that it has never been officially measured by the authorities. In effect, it really means "unregistered". The measurement concerned is comparable with the Spanish "catastro", the land registry. So "unregistered" would be a possible, though free, translation. However, I think the literal "unmeasured" should be used. "Unmeasured land" is a recognised legal concept in English. "Reports may be required as to claims for pre-emption or exemption from conditional sale in respect of improvements effected upon measured and unmeasured land. In such cases care should be taken to afford full particulars under the following heads - such as date of inspection, tenure of land, situation, within pastoral lease, whether in a goldfield, date or dates of erection of or effecting the several improvements, and description and valuation of each improvement, with the detail dimensions of and rates allowed for excavation, fencing, grubbing, and such-like work" http://www.baseline.nsw.gov.au/files/SGD Regulations for Emp... |

without/with no metes and bounds Explanation: When I record a mining claim or site, how do I describe the lands I have claimed? If you cannot describe the land by aliquot part ( e.g., the land is unsurveyed), you must provide a metes and bounds description that fixes the position of the claim… http://ecfr.gpoaccess.gov/cgi/t/text/text-idx?c=ecfr&rgn=div... There are two types of mining claims, lode and placer. Descriptions are by metes and bounds surveys (giving length and direction of each boundary line). http://www.1881.com/minedef.htm WHAT TYPES OF CLAIMS/SITES ARE THERE? Lode - A classic vein, ledge, or other rock in place between definite walls. A lode claim is located by metes and bounds. http://www.blm.gov/ca/st/en/info/iac/faqmc.html On unsurveyed lands, gold mining claims must be described by a metes and bounds description. http://www.theclaimpost.com/BUYERSGUIDE.html For mining claims, metes and bounds surveys are tied to the discovery point. http://www.icmj.com/BLMresourcedoc.htm |
