Der Vermieter übernimmt keine Haftung dafür, dass die etwa notwendigen behördlichen Genehmigungen für den vorgesehenen Betrieb erteilt werden bzw. erteilte Genehmigungen fortbestehen, sofern die Genehmigungen nicht aus Gründen versagt oder aufgehoben werden, die ausschließlich auf der Beschaffenheit oder Lage des Mietobjekts beruhen. Schadensersatzansprüche des Mieters nach § 536a BGB sind in jedem Fall ausgeschlossen. Die Haftung des Vermieters für Vorsatz und grobe Fahrlässigkeit bleibt unberührt.
Der Mieter hat im Übrigen auf seine Kosten die gesetzlichen Voraussetzungen für den Betrieb seines Gewerbes zu beschaffen.
§ 4 Mietzeit, Kündigung, Option
1. Das Mietverhältnis beginnt am 15. Dezember 2007
3. Das Mietverhältnis läuft auf bestimmte Zeit und endet am 31. Dezember 2017 , ohne dass es einer Kündigung bedarf.
(Option) Der Mieter kann das Mietverhältnis bis zum 31. Dezember 2022 verlängern, indem er dem Vermieter diese Absicht sechs Monate vor Ablauf der Vertragsdauer schriftlich mitteilt.
Setzt der Mieter den Gebrauch der Mitsache nach Ablauf der Optionszeit fort, so gilt das Mietverhältnis als auf unbestimmte Zeit verlängert, sofern der Vermieter oder der Mieter binnen einer Frist von zwei Wochen nicht widerspricht.
Translation - German 2. The landlord does not assume any liability that official approvals are assigned for the designated business or assigned approvals continue their validness, provided that the approvals are not denied or lifted for reasons which are exclusively based on the condition or situation of the premises. Claims by the tenant for compensation according to § 536a BGB are excluded in every case. The landlord’s liability for intent and gross negligence remains untouched.
The tenant has to obtain the legal prerequisites for his trade at his expense.
§ Term of Tenancy , Termination, Option Period
1. The tenancy starts on December 15th, 2007
3. The tenancy runs for a specific term and ends on December 31st, 2017 without requiring a termination notice.
(Option Period) The tenant can extend the tenancy until December 31st, 2022 by informing the landlord about this intention 6 months before the completion of this agreement.
If the tenant continues to use the premises after the option period expired, the tenancy is prolonged for an indefinite term, provided that neither the landlord nor the tenant does object within a period of two weeks.
