Bosnian to English: Letter to the Client Regarding the Divorce Procedure in Bosnia General field: Law/Patents Detailed field: Law (general)

Zahvaljujemo Vam se na obraćanju i spremni smo pojasniti svako Vaše pitanje ukoliko je to u okviru našeg znanja.
Na prvom mjestu treba istaći da Vaša supruga nije odustala od procedure ”bez krivice”. Na odluku da se pokuša pokrenuti i okončati posutpak u BiH, je na prvom mjestu uticalo to što bi ovakav postupak u BiH iziskivao puno manje trošova i vremena.
No krenimo redom,
1. BH sud ima jurisdikciju bez obzira gdje je brak sklopljen i da li su supružnici državljani BiH ukoliko su supružnici svoje posljednje prebivalište imali na teritoriji BiH.
Vi i Vaša supruga možete izjaviti da ste posljednje prebivalište imali na adresi na kojoj Vaša supruga i sada živi. Za ovaj podatak nije potreban nikakav dokaz, naprotiv, sud i ne može ispitivati ovaj podatak ukoliko se supružnici slažu sa njim.
2. U svim zemljama je veoma uobičajen postupak priznanja strane sudske odluke. Radi se o posebnom postupku na sudu, no on je u svakom slučaju kraći i sa manje troškova nego postupak razvoda braka. BiH priznaje odluke o razvodu braka iz UK, no Vi svakako trebate provjeriti sa UK advokatom, ili matičarem, da li ima nekih zapreka da se prizna Vaša presuda o razvodu braka iz BH.
3. Obzirom na nepokretnu imovinu, za nju je određena isključiva nadležnost teritorije suda na kojoj se ovakva imovina nalazi. Stoga bi, takođe u cilju uštede vremena i novca, ovaj problem riješili na način da bi napravili niz izjava, ili ugovora kod nadležnih organa, a u kojima bi se regulisalo pitanje nepokretne imovine. Ovakve saglasne volje bi se trebale dati u GB, Mađarskoj i BiH.
4. U skladu sa porodičnim zakonom BiH, nikada se ne ustanovljava krivica jednog od bračnih partnera. Sud odlučuje da razvede brak, ukoliko strana tužitelja dokaže da su odnosi u braku teško poremećeni, što je dalji bračni život učinilo nemogućim.
Ovakav liberalan stav zakonodavca je još izraženiji u postupku razvoda braka koji pokreće po zajedničkom sporazumu. U tom slučaju sud izričito nema prava da ulazi u pitanja koje bračni partneri nisu iznijeli u sporazumu.
5. Sud u slučaju sporazumnog razvoda braka na teritoriji BiH, može intervenisati i voditi isključivo računa o interesu mldb. djece u braku, odnosno putem tima socijalnih službi određuje kojem od roditelja će biti povjereno dijete, te kako će se ostvarivati kontakti sa drugim roditeljem i koja je visina mjesečne alimentacije koju će drugi roditelj plaćati. Sud i socijalne službe intervenišu ukoliko roditelji dogovore nešto protivno interesima djeteta.
6. Osnovni troškovi sporazumog razvoda braka u BiH su oko ... € (ukoliko klijenti imaju istog advokata), a troškovi obrade notarske izjave su oko ... €.
Vaš brak je upisan u matične knjige Sarajeva, kao i Vaša kćerka, tako da ne bi bilo potrebe za bilo kakvim zvaničnim prevodima dokumentacije.
Cijeli postupak bi mogao biti okončan za oko 3 mjeseca, a što uključuje i postupak pred porodičnim posrednikom, centrom za socijalni rad i sudom.
Smatram da Vam je sada dosta jasnije zašto Vaša supruga preferira da se razvod braka obavi u Sarajevu, da se bračna imovina sporazumno podijeli.

Thank you very much for your addressing to us. We will be happy to answer any of your questions within our field of expertise.
At first, we must say that your wife has not abandoned the ”no guilt” procedure. Her decision to try to initiate and finalize the procedure in Bosnia/Herzegovina was mostly influenced by the fact that this type of procedure would require less expenses and less time if done in BiH.
But, let us try to explain this in the following way:
1. Bosnian court has competence regardless of where the marriage was certified and whether the spouses are citizens of BiH or not, as long as the spouses had their last residence on the territory of BiH.
You and your wife may declare that you had your last residence at the address where your wife is still living at. No evidence is required to support this statement. On the contrary, the court may not examine this detail if the spouses are in agreement about it.
2. Recognition of foreign judgement is quite common action in most countries. It is a special procedure at the court, but it is anyway much shorter and with less expenses than divorce proceedings. Although BiH recognizes divorce certificates from the United Kingdom, you are nevertheless advised to check this up with a British lawyer or a registrar against any possible barriers to the recognition of your divorce certificate from BiH.
3. Considering the real property, there is exclusive territorial jurisdiction of the court authorized for the territory where the property is located. Therefore, and in order to save money and time, this problem could be solved in the manner of making several statements or contracts before the competent authorities, which would regulate the issue of real property. These agreements should be made in the UK, Hungary and BiH.
4. According to the family law in BiH, guilt of any one of the spouses is never required to be proved. The court shall grant a divorce in case a plaintiff proves that the marital relations have been aggravated to the extent it makes further marital life impossible.
Such a liberal attitude of the lawmakers becomes even more evident if a divorce proceedings has been initiated by mutual agreement. In that case the court is explicitly not authorized to examine the issues that were not mentioned in the agreement by the spouses.
5. In case of a divorce at will made on the territory of BiH, the court may intervene but only to consider the interests of the under age children in the marriage. In such case the court may decide, with assistance of the teams of social workers, to grant custody of children to one of the spouses and to give instructions on the way of future contact between a child and the other party, as well as on the amount of a monthly alimony to be paid by the other party. The court and the social service may intervene should the parents agree something that would contravene the interests of a child.
6. Basic costs of a divorce at will in BiH are about ... € (if both parties are represented by the same lawyer), while the costs of a public notary statement are about ... €.
Since your marriage as well as your daughter have been registered in Sarajevo, there would be no need for official translation of these documents.
The procedure might be completed within about 3 months, including the procedures before a marriage mediator, social services and the court.
I hope this would help you understand more clearly as to why your wife prefers to finalize divorce proceedings in Sarajevo, in order to divide the marriage property by mutual agreement.
