HAS ADOPTED THIS DIRECTIVE:
Article 1
Directive ... is hereby amended as follows:
1. The following Article shall be inserted:
'Article 4a
Denmark may allow its mortgage credit institutions to continue to include joint and several commitments of members, or of borrowers as referred to in Article 4 (1) in their own funds.
2. Article 8 shall be replaced by the following:
'Article 8
1. Without prejudice to the report referred to in the second subparagraph of Article 2 (2), technical adaptations to be made to this Directive in the following areas shall be adopted in accordance with the procedure laid down in paragraph 2'
3. Article 21 shall be deleted.
4. Article 4 (2) shall be supplemented by the following paragraph:
"2. By way of derogation from paragraph 1, the Czech Republic, Germany, Cyprus, Latvia, Lithuania, Hungary, Malta, Netherlands, Poland, Slovenia, Slovakia and the United Kingdom may start data collection in 2005."
5. the following Article shall be inserted:
"Article 8
This authorisation is subject to the condition that those Member States shall supply comparable data for the year 2004."
6. Annex II shall be replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Niniejszym wprowadza się następujące zmiany do dyrektywy ...:
1. Dodaje się następujący artykuł:
'Artykuł 4a
Dania może nadal zezwalać działającym na jej terenie instytucjom udzielającym kredytów hipotecznych na wliczanie wspólnych zobowiązań udziałowców lub kredytobiorców do ich własnych środków pieniężnych jak określono w art. 4
ust. 1.
2. Art. 8 otrzymuje brzmienie:
'Artykuł 8
Bez uszczerbku dla sprawozdania wymienionego w akapicie drugim art. 2 ust. 2 konieczne poprawki techniczne w niniejszej dyrektywie zostają przyjęte zgodnie z procedurą ustaloną w ust. 2'
3. Uchyla się art. 21.
4. Art.4 ust. 2 uzupełnia się jak następuje:
"2. W ramach odstępstwa od ust. 1 zezwala się Czechom, Niemcom, Cyprowi, Łotwie, Litwie, Węgrom, Malcie, Holandii, Polsce, Słowenii, Słowacji oraz Zjednoczonemu Królestwu Wielkiej Brytanii i Irlandii Północnej na rozpoczęcie zbierania danych w roku 2005.)”
5. Dodaje się następujący artykuł:
„Artykuł 8
Zezwolenia tego udziela się pod warunkiem, że wymienione państwa członkowskie dostarczą porównywalnych danych za rok 2004.”
6. Załącznik II otrzymuje brzmienie określone w Załączniku do niniejszego rozporządzenia.
Artykuł 2
Niniejsze rozporządzenie wchodzi w życie dwudziestego dnia po opublikowaniu w Dzienniku Urzędowym Unii Europejskiej.
Niniejsze rozporządzenie jest wiążące w całej swojej rozciągłości i bezpośrednio stosowane we wszystkich państwach członkowskich.

14. Settlement of Disputes
The parties herewith agree that any dispute between them arising out of the provisions hereof, and/or any transportation or service performed by Carrier pursuant to such provisions, shall be submitted to binding arbitration at the demand of either party. In the event the provisions of this paragraph are invoked, the parties shall appoint an arbitrator each; and the two arbitrators thus named shall name a third individual to serve as an arbitrator. The parties agree to abide by the majority decision of the three-member arbitration panel chosen as specified hereinabove, and expressly waive and abjure any rights they might otherwise possess to bring legal action against one another or otherwise dispute or appeal from the decision of such arbitrators.
15. Non-Disclosure
The parties agree that they shall not themselves, nor through agents, employees or by means of third parties, knowingly disclose the contents hereof, nor the contents of the Schedule of Rates and Charges, to any other party whomsoever; and that they shall not knowingly permit, agree to or abet such disclosure by any other party; except that Shipper may, in connection with bona fide auditing of its freight bills, disclosure the contents hereof and/or the contents of the Schedule of Rates and Charges to the individual(s) or organisation(s) engaged by it to perform such auditing subject to execution of an agreement by such individual(s) or organisation(s) that he, she, it or they, as the case may be, shall hold such information in confidence and shall not disclose such information to any person or organisation not a party hereto.
Translation - Polish UMOWA NA ŚWIADCZENIE USŁUG TRANSPORTOWYCH
14. Rozstrzyganie sporów
Strony niniejszym uzgodniły, że wszelkie spory pomiędzy nimi odnoszące się do przepisów niniejszej umowy i/lub usług transportowych lub innych świadczonych przez Przewoźnika działającego w oparciu o te przepisy, na wniosek którejkolwiek ze stron, podlegają arbitrażowi w sposób wiążący. W przypadku, gdyby miały zastosowanie przepisy niniejszego ustępu, każda ze stron powoła arbitra a następnie, powołani w ten sposób arbitrzy powołają trzeciego arbitra. Strony zobowiązują się podporządkować się decyzjom większości trzyosobowego składu arbitrażowego powołanego zgodnie z wyżej wymienioną procedurą i całkowicie zrzekają się wszelkich posiadanych praw do występowania na drogę prawną przeciwko sobie nawzajem lub do podważania i odwoływania się od decyzji tychże arbitrów.
15. Poufność
Strony niniejszym uzgadniają, że nie będą samodzielnie, za pośrednictwem swych przedstawicieli, zatrudnionych pracowników, ani osób trzecich świadomie ujawniały treści niniejszej umowy, ani cennika opłat transportowych żadnym osobom postronnym oraz, że nie będą świadomie zezwalały, wyrażały zgody ani nakłaniały do ujawniania tych informacji innych osób z wyjątkiem sytuacji, w których Nadawca upoważniony jest do ujawnienia treści niniejszej umowy i/lub cennika opłat transportowych w związku z przeprowadzanymi w dobrej wierze kontrolami kwitów przewozowych osobom lub instytucjom powołanym przez niego do przeprowadzenia tych kontroli na mocy umowy zawartej z tymi osobami lub instytucjami zobowiązującej je do zachowania uzyskanych w ten sposób informacji w tajemnicy i do nieujawniania ich żadnym osobom lub organizacjom nieuwzględnionym w niniejszej umowie.
