تنص المادة 45 من القانون المدني ما يلي:
لا يكون أهلاً لمباشرة حقوقة المدنية من كان فاقد التمييز لصغر السن أو عته أو جنون، ويحق للمحكمة أن تحجر على المجنون وذو الغفلة والسفيه، وبمجرد تسجيل قرار الحجر يعتبر المجنون أو المعتوه عديم الأهلية، ويقع باطلاً تصرف المجنون والمعتوه إذا صدر التصرف بعد تسجيل قرار الحجر، أما إذا صدر التصرف قبل تسجيل قرار الحجر فلا يكون باطلاً إلا إذا كانت حالة الجنون أو العته شائعة وقت التعاقد أو كان الطرف الآخر علي بينة منها.
وقد قررت المادة 67 من ذات القانون ما يلي:
يجوز للمحجور عليه للسفه أو ذي الغفلة بإذن من المحكمة أن يتسلم أموالة كلها أو بعضها لإدارتها وفي هذه الحالة تسري عليه الأحكام التي تسري في شأن القاصر المأذون.
| Translation - English
Article No. 45 of the civil law states the following:
Those who lack sound judgment for juvenility, imbecility or insanity are not legally competent to assume their civil rights. The court may place under legal guardianship the insane, the moron or the spendthrift. Once the verdict of the legal guardianship is pronounced, the insane or the imbecile shall not be considered legally accountable. And Therefore, actions taking by the insane or the imbecile after the pronouncement of the set verdict are void, actions taking by the insane or the imbecile before the set verdict are not void unless the state of insanity or imbecility was prevalent at the time of contracting or prevalent to the second party.
Article No.67 of the same act states the following:
Those who are under the legal guardianship for being spendthrift or moron may receive, by court permission, all or part of their movable or immovable property to administer it. And Therefore, articles of the minor under legal guardianship are applicable in such cases.
