Source text - English 1. INTRODUCTION TO DEALING WITH WORLDSPREADS.
1.1 We are Worldspreads Limited, a company registered in England and Wales (Company Number 4898762) and regulated by the Financial Services Authority (Firm Number 230730). Where you are dealing with us in another name (through a white labelling arrangement) or have been introduces to us by an intermediary, the services to be provided to you under this agreement will be provided by us. The intermediary or white label partner provides marketing services to us and is remunerated by us on the basis of the overall profits attributed to the business generated by their efforts. Any services provided or to be provided to you by them will not be provided by WorldSpreads and will not be covered by this agreement.
1.2 Under the rules of our regulator, we have categorised you as a retail customer for the purpose of this agreement and the spread betting business that we will be undertaking with you. This is the most common categorisation for consumers of financial services and is the one to which the highest levels of regulatory protection are afforded. If you are aware of an alternative categorisation which you feel would better reflect the level of service you require from us then you should provide us with details of how you would like to be categorised and the reasons why you feel such a categorisation would be appropriate. Where we are permitted to do so under the rules of our regulator, we will re-categorise you in accordance with your request.
1.3 This Customer Agreement, as updated from time to time, shall govern all such bets between you and WorldSpreads Limited (WS) (including any bets placed by an Agent pursuant to clause 3.5 or other person giving the client's name and account number or account number and password as referred to in clause 3) and should be read in full, along with the Risk Disclosure Notice and any other documents which we may have supplied to you. This Customer Agreement, the Risk Disclosure Notice and related documents will contain certain words and expressions that are defined in Clause 20 of this Customer Agreement. Unless we both agree otherwise, all communications between you and us will be in English.
Translation - Russian 1. ПРЕДВАРИТЕЛЬНЫЕ ЗАМЕЧАНИЯ О ПРИНЦИПАХ СОТРУДНИЧЕСТВА С КОМПАНИЕЙ «WORLDSPREADS»
1.1 Компания «WorldSpreads Limited» зарегистрирована в Англии и Уэльсе (номер компании - 4898762) и подконтрольна Управлению по финансовому регулированию и надзору Великобритании (номер фирмы – 230730). Если вы работаете с нами под другим названием (в рамках соглашения о предоставлении услуг без распоряжения брэндом компании) или были представлены нам посредником, предоставляемые вам по данному соглашению услуги будут оказываться нами. Посредник или партнер, действующий в рамках соглашения о предоставлении услуг без распоряжения брэндом компании, предоставляет нам маркетинговые услуги и получает от нас вознаграждение в зависимости от общей прибыли от сделок, заключенных при его содействии. Любые услуги, которые оказываться или будут оказаны вам таким посредником, не предоставляются компанией «WorldSpreads» и на них не распространяется данный Договор.
1.2 Согласно правилам нашего регламентирующего органа, для настоящего Договора и торговли спрэдами, которой мы с вами будем заниматься, мы отнесли вас к категории индивидуальных клиентов. Это самая общая категория клиентов, получающих финансовые услуги. Клиентам этой категории предоставляется самый высокий уровень нормативной поддержки. Если вам известно о какой-либо другой категории, которая, по вашему мнению, лучше отражает тот уровень обслуживания, который вы желали бы получить у нас, сообщите нам о том, к какой категории вы бы хотели быть отнесены, и приведите причины, по которым такая категория была бы для вас более подходящей. Если мы получим разрешение от нашего регламентирующего органа на такое изменение категории, мы по вашему требованию изменим вашу категорию в соответствии с вашим запросом.
1.3 Настоящий Договор с клиентом, с учетом периодически вносимых в него изменений, регламентирует все сделки между вами и компанией «WorldSpreads Limited» (WS) (в том числе все сделки, предложенные Агентом в соответствии с пунктом 3.5 или другим лицом, которое сообщает имя клиента и номер его счета, или номер счета и пароль, как указано в пункте 3), необходимо прочитать полностью, вместе со Справкой о раскрытии информации по рискам и любыми другими документами, которые мы подготовим для вас. Настоящий Договор с клиентом, Справка о раскрытии информации по рискам и сопутствующие документы содержат некоторые слова и выражения, определенные в пункте 20 настоящего Договора с клиентом. Если обе стороны не договорятся об ином, все контакты между вами и компанией «WorldSpreads Limited» будут производиться на английском языке.
