Source text - Spanish Rechtliche Aspekte des Frauenhandels in der Schweiz
Silvia ist Opfer von Frauenhandel. Die Handlungen der Täter fallen unter den Straftatbestand von Art. 182 StGB (Menschenhandel); danach wird mit Strafe bedroht, „Wer als Anbieter, Vermittler oder Abnehmer mit einem Menschen Handel treibt zum Zwecke der sexuellen Ausbeutung, der Ausbeutung seiner Arbeitskraft oder zwecks Entnahme eines Körperorgans (…)“. Bisher gab es in der Schweiz nur wenige Verurteilungen wegen Menschenhandel und es wurden niedrige Strafmasse ausgesprochen. 2008 waren es 8 Verurteilungen. Eine geringe Zahl, wenn man die 167 Fälle bedenkt, die 2008 von Makasi begleitet wurden.

Als Opfer von Frauenhandel hat Silvia wie andere Opfer einer Straftat gegen die körperliche, psychische oder sexuelle Integrität, Anspruch auf Hilfe gemäss Opferhilfegesetz. Über das Opferhilfegesetz können eine Notunterkunft, therapeutische und anwaltliche Unterstützung finanziert werden. Trotz diesen Opferrechten erhalten die Betroffenen in der Schweiz keinen langfristigen Schutz. Ihr Aufenthaltsrecht ist an die Bedingung geknüpft, dass sie mit den Behörden kooperieren. In einer Bedenkzeit von 30 Tagen müssen sie sich entscheiden, ob sie gegen die Täter aussagen wollen. Wenn sie dazu bereit sind, dürfen sie bleiben. Allerdings nur so lange, wie sie für ein Verfahren gebraucht werden. Danach müssen sie zurück in ihr Herkunftsland. Nur in Ausnahmefällen erhalten Opfer von Frauenhandel in der Schweiz einen langfristigen humanitären Aufenthalt.

Silvia es víctima de trata de mujeres. Los actos de los delincuentes se subsuman bajo el tipo penal del artículo 182 del Código Penal (trata de personas) el cual prevé sanción para “quien como proveedor, mediador o consumidor practique el comercio con seres humanos con el fin de la explotación sexual, de la explotación laboral o con el fin de la extirpación de un órgano del cuerpo (…)”.
Hasta hoy en día se han dictaminado muy pocas sentencias condenatorias por trata de personas en Suiza y las penas impuestas han sido bajas. Ha habido ocho sentencias condenatorias durante el 2008. Es una cifra muy pequeña considerando los 167 casos acompañados por Makasi en 2008.

Silvia tiene, como víctima de trata de mujeres e igual que otras víctimas de delitos contra la integridad física, psíquica o sexual, derecho a ayuda según estipula la Ley para la Ayuda a las Víctimas. La Ley para la Ayuda a las Víctimas permite la financiación de alojamiento provisorio, apoyo terapéutico y jurídico. A pesar de estos derechos de víctimas las personas afectadas no obtienen una protección a largo plazo en Suiza. Su derecho de estancia está condicionado por la cooperación con las autoridades. En un tiempo de reflexión de 30 días tienen que decidirse si quieren declarar contra los delincuentes. Si acceden pueden quedarse. Pero sólo por el tiempo que su presencia es necesaria en el procedimiento jurídico. Después tienen que regresar a su país de origen. Sólo en casos excepcionales las víctimas de trata de mujeres obtienen un derecho de estancia por razones humanitarias a largo plazo.
