(To the verdict of the Soviet region of Minsk court from the 17th of March 2014)
On the 17th of March 2014 by the Soviet region of the city of Minsk court was annonced a verdict for indicting me for administrative offence, provided by the article 1 clause 23.34 of KoAP of the Republic of Belarus. According to the above verdict I was subject of an administrative sanction in the form of arrest for 10 days.
I presume that the announced court’s verdict was illegal and unreasonable.
According to the article 12.14-1 of PiKoAP of the Republic of Belarus, grounds for cancellation of a verdict, entered or not entered into legal force, are: sideness, incompleteness and non-objective investigation of the circumstances.
During the course of the court’s case I claimed not guilty in administrative offence, contradictorily, I clarified that on 17th of March 2014 at 10.40 AM, being at the next to the market square along the Khoryzhey str 8 in the city of Minsk, I was dressed in an agitation t-shirt with slogans of the pre-electoral campaign of the candidate for MP in the Mingorsovet* Gilko A. N. and I was holding in my hands the photograph of Yuri Zaharenko , who disappeared on the 7th of May 1999. Pre-electoral thesis of Gilko was “Freedom for the political prisoners”. In this regard I was wearing the t-shirt with the same lettering. I knew from trustees of the MP candidate Gilko A. N. that in the ideology and policy department of Mingorispolkom** had been submitted a notification about the conduction of a mass event in the form of a picket in support of the pre-electoral campaign of the above mentioned MP candidate. In regards to all this I decided to take part in the above mass event.
If I knew that the event was not authorised I wouldn’t have taken place in it in any case.
Being interrogated in the court’s session the witness Gilko A.N. clarified that on 13th of March 2014 he contacted Mingorispolkom** and submitted a notification about the conduction of a mass event for the goals of the pre-electoral agitation for himself, as for a MP candidate for the Minsk city council. Within the article 45-1 of the Electoral Codex of the Republic of Belarus he has completed all the requirements of the Law about the conduction of mass events, organised by MP candidates and their trustees. In confirmation of his words the above witness showed in the court the original of the notification about the conduction of the mass event and pleaded to attach a copy of the above document to the materials of the case. I will note that there is a reference number, under which the notification, directed to Mingorispolkom** was registered.
