Source text - Dari 1. تعریف جزاء:
جزا، مشقتی است قانونی که از طرف محکمه بر مجرم تحمیل می شود.
از این تعریف چند ویژگی جزا روشن می شود.
جزا، مشقت بار است. بنابراین توأم با لطف و احسان نیست.
این مجازات توسط قانون تعیین شده است.
مشقت مذکور از طرف محکمه و طی فیصله رسمی اعلام می گردد.
مشقت قانونی مذکور فقط به مجرمان قابل تطبیق است نه غیر آنها.
در اصطلاح، جزا به معناي مجازات و سزاي عملي است که قانون آن را جرم دانسته و نيز متضمن اجراي آن است. به عبارت ديگر؛ جزا يا مجازات از ديدگاههاي علوم جزايي، عبارت است از عکسالعمل اجتماعي به صورت رنج و تعبي که بر مجرم اعمال ميشود.
Translation - English Definition of Penalty:
Punishment is a lawful hardship that is imposed by court to a criminal.
The above definition specifies a few characteristics of crime.
Punishment is excruciating, so it is not dual with grace and boon.
This punishment is set by the law.
The mentioned hardship is declared by the court during an official hearing.
The said legal hardship applies only to the criminal not to the ones other than him/her.
The term penalty means the punishment or compensation of an act that the law has recognized as a crime and it’s enforcement is guaranteed by the law. In another word; from the perspective of criminal sciences the penalty or punishment is a social reaction in the form of suffer and discipline that is imposed to the criminal.
