English to Russian: Literature as a System General field: Art/Literary Detailed field: Linguistics
Source text - English Literature is a system, embedded in the environment of a culture or society. It is a contrived system, i.e. it consists of both objects (texts) and people who write, refract, distribute, read those texts. It is a stochastic system, i.e.
one that is relatively indeterminate and only admits of predictions that have a certain degree of probability.
The literary system possesses a regulatory body: the person, persons, institutions (Maecenas, Emperors, noblemen, provincial governors, the Church, the Fascist or Communist Party) who or which extend(s) patronage to it. Patronage consists of at least three components: an ideological one (literature should not be allowed to get too far out of step with the other systems in a given society), an economic one (the patron assures the writer’s livelihood) and a status component (the writer achieves a certain position in society). Patrons rarely influence the literary system directly; critics will do that for them, teachers, members of academies.
The literary system also possesses a kind of code of behaviour, a poetics. This poetics consists of both an inventory component (genre, certain symbols, characters, prototypical situations) and a “functional” component, an idea of how literature
has to, or may be allowed to, function in society.
English to Russian: Transformations in the Concept of Family General field: Social Sciences Detailed field: Social Science, Sociology, Ethics, etc.
Source text - English Changes in economic opportunities have also altered the attitude of many women toward both marriage and divorce. Women who can earn enough to support themselves are not under the same pressure to marry that many women felt a century ago. Society expected a woman to forego education, marry young, stay at home, and become a “domestic engineer”, condemned to remain in the marriage. To leave the marriage, a woman needed marketable skills that would enable her to exist financially on her own. Today, young women have the opportunity to acquire an education and thus the financial independence necessary to make important choices such as whether to marry and whether to remain married.
Attitudinal changes have had and will continue to have an impact on marriage and divorce. Divorce is no longer a stigma and government no longer makes it difficult. Single-parent families are now not only more frequent but more commonly accepted. Indeed, the growing number of alternative living arrangements increases the likelihood that the concept of family will continue to undergo transformation as the law evolves, taking into account these new arrangements.
English to Russian: THE CIVIL WAR General field: Other Detailed field: History
Source text - English From the outset, questions about law, particularly the location of legal authority, were central to the Civil War. Secessionists, of course, asserted state sovereignty over most legal issues. At the outbreak of the war, debates over states' rights had become inextricably tied to sectional differences connected to slavery. Those claiming to represent "the South" advocated an extreme states' rights position, whereas their counterparts from "the North" predicted the end of the Union should such a view prevail. Yet the polarized rhetoric overstated the differences between the two sections. It also oversimplified the underlying issues by conflating questions about governing structures with disagreements over the content of the resulting decisions. Those issues centered on federalism — the relative balance of legal authority between states and the federal government. Federalism had not always divided the nation into opposing geographic sections. At the time of the nation's founding, for instance, Southern slave holders were among those advocating a stronger federal government. In 1832, during the Nullification Crisis, most Southern political leaders still rejected the extreme states' rights position of South Carolina radicals. Even in subsequent decades, as states' rights became a lightning rod for sectional differences, the rhetoric did not accurately describe federalism's practical dynamics, to which the balance of state and federal authority was as much a means as an end. Political leaders shifted back and forth, depending on the particular issue. Stances on the Fugitive Slave Act (1850) and the U.S. Supreme Court's decision in Dred Scott (1857) are representative.
English to Russian: Norms and Enforcement: The Case Against Copyright Litigation (by BEN DEPOORTER* AND SVEN VANNESTE**) General field: Law/Patents Detailed field: Law: Patents, Trademarks, Copyright
Source text - English In a second part of the study, we informed students that enforcement
against file sharing had now dropped to zero because
of perfect anonymity afforded by new technology. This scenario
is realistic in the context of the ongoing arms race between
content providers on one side and pirates and hackers on the
other. In this technological race, copy protection and circumvention
play catch-up. At times where the hackers have the upper
hand, the situation resembles that of the present scenario: file
sharers do not fear enforcement because technology provides anonymity.
This emphasizes the importance of social norms in
the context of copyright enforcement. Whenever technological
advances in private copying have not yet been countered by content
owners, either through technological self-help or judicial
evaluation, norms are a strong determinant of conduct.
In order to get a measure of the effect of copyright enforcement
in times when there is a lag in enforcement, we asked respondents
whether, during this protected period, “[t]he
enforcement policy of the music industry prior to the introduction
of the new protective software influences the amount of music
I will resume downloading.”
a. Results
First, none of the respondents indicated that prior enforcement
strategies would fundamentally affect their behavior. All of the
answers were in the 4 to 5 range on a scale in which 7 denoted
strong agreement. Second, prior enforcement policies had different
effects on present and potential file sharers. The x-axis in
Figure 4 differentiates between heavy (right-hand side) and low
(left-hand side) severity of punishment. The y-axis displays, in
increasing order, how the enforcement policy of the music industry
prior to the introduction of the new protective software influences
the amount of music students will download. Heavy
punishment schedules in times of enforcement led file sharers
(black line) to higher levels of downloading during enforcement
lags (M = 5.24) relative to individuals without file-sharing experience
(shaded line) (M = 4.57). The converse result emerged with
regard to punishment in the lower range. Potential file sharers
(shaded line) downloaded more during an enforcement downtime
(M = 5.26) relative to present file sharers (M = 4.54). In
other words, penalties for copyright offenses had opposite effects
on those respondents without file-sharing experience and those
with file-sharing experience.
