Source text - Chinese 为保护住宅房屋买卖双方的合法杈益，明确双方的权利和义务，依据国家法律和本市的有关法规及政策，根据（99）京房改字第129号文件规定，经双方协商，就下列房屋的买卖订立本协议，双方共同遵守。一. 甲方将座落在东城区新中西街12号楼1门303号楼房一套，总建筑面积38.75平方米，出售给乙方，房屋单方售价每建筑平方米1485元。经计算，实际售价为35929元。乙方应交纳公共维修基金1151元，合计实付金额37080元。付款方式：一次性付款。二. 甲方根据《关于1999年向职工出售公有住宅楼房的价格及有关政策的通知》及乙方条件，执行房改规定的优惠政策。三. 甲方协助乙方到房地产交易所办理立契过户手续，各项费用由乙方按规定交纳。四. 乙方购房后，供暖费用的收取，仍执行原文件规定按期交纳。物业管理费用的收费，按北京市居民小区物业管理的有关规定执行。五. 乙方按购房面积，每建筑平方米交纳29.7元公共维修基金，由乙方按京房改办字(1999)第1088号文件规定同房价款一并交纳。基金利息用于维修公共部位和公用设施，不足时由乙方按占有面积比例分摊。六. 乙方应爱护使用公共设施，楼梯间、门道、走廊、屋顶等公用部位，乙方不得私自占用。对楼房的建筑结构，暖气、煤气、上下水，供电等设施，严禁私自拆改。擅自拆改的，乙方应负责恢复原状或赔偿。室内维修由乙方负责。甲方按规定检査、维修毗连房屋时，乙方应积极协助，不得拒査、拒修，因拒查、拒修造成的损失由乙方负责。七. 乙方购房后，即享有房屋所有权，可依法使用、继承、抵押。八. 乙方为第一次购买自管公有住宅，可免交契税；购房后自住期间，免交房地产税和土地使用税。九. 乙方购房后，可以依法进入市场，在补交土地使用权出让金或所含土地收益和按规定交纳有关税费后，其收入按届时有关政策办理。十. 甲、乙双方任何一方违反本协议发生争议时，均有权提出要求共同协商或遵照国家法律解决。十一. 本协议自签订之日起生效。本协议一式四份。原签定的《公有住宅租赁合同》同时废止。	Translation - English In order to protect the lawful rights and interests of seller and buyer of residence house and clearly define both parties’ rights and obligations, according to China’s laws and relevant regulations and policies of the city, as well as the regulations of (99) J.F.G.Zi No. 129 Document, both parties, after negotiations, conclude and enter into the Agreement on the following house and jointly abide by the Agreement. I. Party A sells to Party B the house, which is located at No. 303, Door 1, Building 12, Xinzhongxi Street, Dongcheng District, covering an area of 38.75m2. The selling price of the house is 1485 Yuan/m2.After calculation, the actual selling amount is 35,929 Yuan.Party B shall pay 1,151 Yuan as public maintenance fund. The total amount actually paid is 37,080 Yuan. Type of payment: lump-sum payment. II. According to the Notice of Price of Selling Public Housing to Staffs in 1999 and Relevant Policies as well as Party B’s conditions, Party A implements preferential policies of housing system reform regulations. III. Party A shall assist Party B to handle transfer procedures in real estate exchange office, and all the expenses arising hereof shall be borne by Party B according to regulations. IV. After Party B buys the house, the heating expense shall be charged according to regulations of original document on schedule. The property management fee shall be charged according to relevant regulations of property management of resident community of Beijing. V. Party B shall pay 29.7 Yuan/m2 as public maintenance fund according to the area of the house, and shall pay house amount at the same time according to regulations of J.F.G.B.Zi (1999) No.1088 Document. The fund interest is used for maintaining public parts and public facilities. If the fund interest is not enough, Party B shall pay it according to the proportion of occupancy area. VI. Party B shall care public facilities, and public parts of staircase, gateway, corridor, roof, etc., and shall not occupy it privately. The building architectural structure and facilities of heating, coal gas, water supply, power supply, etc. shall not be removed or changed without authorization. Where the facilities are removed, Party B shall be responsible for restoration or compensation. Party B shall be responsible for indoor maintenance. Where Party A inspects or repairs adjacent houses according to regulations, Party B shall assist Party A positively, and shall not refuse inspection or repair. Where Party B refuses inspection or repair, the losses caused hereof shall be borne by Party B. VII. After Party B buys the house, Party B enjoys the house ownership and may use, inherit or pledge the house according to law. VIII. If Party B buys self-management public house for the first time, Party B doesn't need to pay deed tax. After buying the house, Party B doesn’t need to pay real estate tax and land-use tax during living. IX. After Party B buys the house, the house can enter market legally. After paying assignment fee of land-use right or included land revenue and paying relevant taxation expense according to regulations, its income shall be handled according to relevant policies at that time. X. Where Party A or Party B violates any dispute of the Agreement, the observant party shall have right to demand negotiation jointly or settle the dispute according to China’s laws. XI. The Agreement shall be effective upon signing, and shall be in quadruplicate. The original Public Housing Leasing Contract signed previously shall be null and void at the same time.
