a) samochód brudny - 20,00 PLN
b) samochód nieposprzątany – 10,00 PLN
2. Wynajmujący zastrzega sobie prawo rozliczenia wszelkich, wynikających z niniejszej Umowy nieuregulowanych należności z kwoty kaucji wpłaconej przez Najemcę.
§ 7
Najemca ponosi odpowiedzialność za usterki spowodowane nieprawidłową, eksploatacją pojazdu wymienionego w § 1.
1. W przypadku stwierdzenia innych usterek Najemca zobowiązany jest do ich usunięcia na własny koszt, który zostanie zwrócony po przedstawieniu rachunku i weryfikacji naprawy.
2. W przypadku kolizji, wypadku, kradzieży wymagana jest bezwzględnie notatka lub protokół z Policji. W razie braku protokołu lub notatki pełny koszt naprawy oraz inne koszty nie pokryte ponosi Najemca. Jeśli uszkodzenie lub kradzież pojazdu nastąpi z winy Najemcy ponosi on koszty nie pokryte przez ubezpieczenie.
§ 8
Najemca oświadcza, że:
1. W razie kolizji lub wypadku spowodowanego pod wpływem alkoholu lub innych środków odurzających ponosi pełną odpowiedzialność finansową oraz prawną za powstałe szkody.
2. Nie będzie podnajmował pojazdu osobom trzecim oraz nie będzie opuszczał terytorium miasta Krakowa bez pisemnej zgody Wynajmującego.
3. Są mu znane ogólne warunki ubezpieczeń OC i AUTO CASCO i będzie się do nich stosował.
§ 9
Najemca opuszczając samochód ma obowiązek zabrać ze sobą kluczyki oraz dokumenty przedmiotowego samochodu.
§ 10
Najemca ponosi pełną odpowiedzialność finansową za uzyskane mandaty karne, oraz inne opłaty nie uiszczone a otrzymane w związku z użytkowaniem samochodu wymienionego w §1.
§ 11
Wynajmujący zastrzega sobie prawo odmowy usługi lub zerwania umowy bez uprzedzenia oraz podania przyczyn.
§ 12
W sprawach nie uregulowanych niniejszą umową mają zastosowanie przepisy kodeksu cywilnego oraz innych aktów normatywnych związanych ze sprawą.
§ 13
Umowa została sporządzona w dwóch jednakowych egzemplarzach, po jednym dla każdej ze stron.

Lessee will use the car strictly in accordance with the time period specified by the agreement, with payment made in advance.
§ 5
1. If the rental period is extended without notification of the Lessor, charges will be doubled for each extra hour of rental.
§ 6
1. After the expiration of the agreement the Lessee is obligated to return the car with both a clean exterior and tidy interior. Otherwise, the Lessor has the right to impose the following extra charges.
a) Dirty exterior - 20,00 PLN
b) Untidy interior – 10,00 PLN
2. The Lessor reserves the right to settle any pending debt arising from this agreement using funds from the deposit paid by the Lessee.
§ 7
The Lessee is liable for any damages caused by improper vehicle use. § 1.
1. In the case of other damages, the Lessee is obligated to repair them at his/her own cost, which will then be refunded after presentation of the bill and verification of repair.
2. In the case of a collision, accident, or theft, it is absolutely necessary that the police are summoned to record the incident. Failure to do so will subject the Lessee to the full cost of repair as well as other uncovered costs. If the damage or theft is the fault of the Lessee, he/she will be required to cover all costs not covered by insurance.
§ 8
Lessor declares that:
1. In the case of a collision caused under the influence of alcohol or other intoxicating substances he/she will assume full legal and financial responsibility for the damages.
2. He/she will not sublet the vehicle to third parties and will not leave Kraków city limits without written agreement from the Lessor.
3. He/she is familiar and will comply with the stipulations of OC and AUTO CASCO insurance.
§ 9
When leaving the vehicle the Lessee is obliged to take its keys and registration/insurance documents with him/herself.
§ 10
Lessee assumes full responsibility for all criminal fines and other unpaid fess associsted with the use of the listed vehicle. §1.
§ 11
Lessor reserves the right to refuse service or terminate the agreement without warning or justification.
§ 12
Regulations of the Civil Code, as well as other relevant legal acts, will be applied to matters not addressed by the present agreement.

Jako główny organizator festiwalu METALFEST 2013, który odbywał się w Jaworznie w dniach 20-22 czerwca 2013 roku, a zarazem właściciel firmy Knock Out Productions jestem oburzony nie wywiązaniem się zespołu Volbeat z występu podczas festiwalu, przez co zostaliśmy narażeni na straty finansowe i przede wszystkim wizerunkowe, których nie da się wyrazić w pieniądzach.
Oświadczenie wystosowane przez zespół, że „nie mógł wystąpić , ponieważ zespół produkcyjny wraz z technicznymi dostrzegli pewne poważne problemy dot. bezpieczeństwa zw. z budową sceny …” oraz raport techniczny z fotografiami wg Państwa potwierdzającymi nieprawidłowości, a także oczekiwanie zapłaty pełnej kwoty za niezrealizowany występ są dla mnie niezrozumiałe i całkowicie bezzasadne.
Budowa sceny była zlecona profesjonalnej Firmie o dużym doświadczeniu , która posiadała kompletną dokumentację potwierdzającą bezpieczeństwo sceny, a także gotowa była do uwzględnienia wszelkich Państwa uwag przed montażem sprzętu zespołu Volbeat, a z której to państwo szansy nie chcieli skorzystać.
Zdumiewający jest fakt, że tylko zespół Volbeat spośród kilkudziesięciu zespołów zakwestionował bezpieczeństwo sceny. Takie zachowanie skłania do refleksji, iż Państwa zamierzeniem było odwołać koncert bez przyczyny i udać się do Francji na swój kolejny koncert, gdzie w dniu 23 czerwca wystąpiliście jako gwiazda wieczoru.
Dla mnie jako organizatora festiwalu METALFEST 2013 Państwa zachowanie i potraktowanie fanów jest niepoważne, nieodpowiedzialne i nieprofesjonalne.
Państwa zachowanie naraziło mnie, jako organizatora na duże straty finansowe związane ze zwrotami biletów oraz podważenie wiarygodności mojej firmy jako liczącego się w Polsce organizatora w branży muzycznej, co jest stratą bezcenną.
Mimo, ewidentnej szkody po mojej stronie, wnoszę do Państwa o polubowne rozwiązanie sporu.

As the main organizer of METALFEST 2013, which took place in Jaworzno from the 20-22 of July, as well as the owner of Knock Out Productions, I Tomek Ochab am writing to express my strong discontent with the failure of Volbeat to perform the concert scheduled for Friday the 21st of this year. Not only did this incident subject me and my company to financial loss, but above all to loss of reputation.
The statement issued by the band that „Volbeat could not play because the production team found the construction of the stage to be unsafe”, the raport techniczny z fotografiami wg Państwa potwierdzającymi nieprawidłowości, as well as the expected payment for a cancelled performance are for me incomprehensible and unfounded.
Despite the fact that the construction of the stage was commissioned to an experienced firm, which is certified in stage safety, and all of Volbeat’s demands were taken into consideration before assembling the band’s equipment, the management didn’t want to take a chance.
What is astonishing is that out of dozens of bands, only Volbeat questioned the safety of the stage. Immediately followed by a subsequent concert in France, where on the 23rd of June Volbeat played the headlining concert, the band’s refusal to perform in Jaworzno 2 days earlier raises some questions.
I judge the behavior and treatment of fans by the Volbeat management team to be irresponsible and unprofessional; and I am deeply offended, with respect to both a big loss related to ticket refunds, as well as the detriment to the credibility of my company as a reputable concert agency in Poland, which is priceless.
In spite of losses suffered, I kindly ask for an out-of-court settlement to the current dispute.
