Source text - Romanian Within 2 (two) days after signing this lease, The Lessee, at its own expense, will provide The Comfort Letter after having it previously approved by its Lessor and by his bank. The Comfort Letter shall be the same as it is in Annex 9.1 This Comfort letter will be valid until the contractual term expires, with an extension to a certain period of time, plus 1 month (one). If the warranty has a validity of 1 year it will be renewed every year under the same terms and liabilities. The guarantee will be returned to the Lessee after the contractual term is completed if the Lessee complied with all terms under this Lease Agreement. During the period of this Lease, the present Guarantee will not be offered or paid both partially and fully in any form, by The Lessee as payment of base rent and / or any other amounts due to this Lease Agreement or as a compensation for not carrying into effect of a certain contractual agreement without the permission of the Lessor. Despite the above-mentioned instructions set out in this clause, breaking the Tenancy Agreement will give The Lessor the right to use warranty as compensation for debts due and damages.
Translation - English In termen de 2 (doua) zile de la semnarea prezentului contract, Locatarul, pe propria cheltuială, va furniza Scrisoarea de Garanție Bancară după ce a fost aprobată anterior de către Locator și de către banca acestuia. Scrisoarea de Garanție Bancară va avea forma furnizată în Anexa 9.1
Această Garanție va fi valabilă până la expirarea termenului contractual, cu prelungire la anumite perioade, plus 1 luna ( una). În cazul în care garanția are o perioadă de valabilitate de 1 an, va fi reînnoit în fiecare an, pe baza acelorași condiții și răspunderi. Garanția va fi returnată Locatarului după implinirea termenului contractual, cu condiția și imediat ce Locatarul a respectat toate obligațiile conform prezentului Contract.
Pe durata perioadei acestui Contract, prezenta Garanție, sub nicio formă, nu va fi oferită sau plătită atât parțial cât și în întregime de către Locatar ca și plată a chiriei de bază și/sau a oricărei alte sume datorate conform acestui Contract sau ca despăgubire pentru (ne) efectuarea oricărei obligații contractuale, fără permisiunea Locatorului.
