DMCC STANDARD
CONTRACT OF EMPLOYMENT
BETWEEN
[EMPLOYER]
AND
[EMPLOYEE]
FOR UNLIMITED PERIOD EMPLOYMENT CONTRACTS
THIS CONTRACT OF EMPLOYMENT (‘Contract’) dated the ………… day of ………. [YEAR] is made between the following parties (‘Parties’):
BETWEEN
(1) [EMPLOYER], a company licensed by Dubai Multi Commodities Centre Authority (the "DMCCA") to operate in the Jumeirah Lakes Towers Free Zone (the ‘Territory’) with trade license number [NUMBER] whose registered office is at [ADDRESS](the ‘Employer’);
AND
(2) [EMPLOYEE] a national of [COUNTRY] and holder of [COUNTRY] Passport number [NUMBER] of [ADDRESS] (the ‘Employee’).
1. Article One - Term
1.1 The Employee shall work for the Employer as [JOB TITLE] at [COMPANY NAME AND ADDRESS] being the Employee’s normal place of work in the Territory for an unlimited period commencing on [DAY] day of [MONTH] [YEAR] (‘Term’). This position is/is not (please delete as appropriate) deemed a responsible senior position in the management or supervision of the Company.
1.2 The Employee shall be subject to a probationary period of [PERIOD] month(s) (shall not exceed six months from the beginning of employment) (‘Probation’).
1.3 The Employee shall not, during the period of his/her employment, work outside the Territory or for another Employer whether in the Territory or otherwise, except with prior written approval from the Employer and any concerned authority having jurisdiction over such matters in the place where the Employee intends to work.
1.4 The Employer undertakes to notify DMCCA of any change to the terms of Employment in relation to the Employee’s position, period of employment, salary, allowances and/or additional benefits.
2. Article Two – Remuneration
2.1 The Employee shall be paid a basic salary of AED [SALARY] per month which shall be payable monthly in arrears on or about the [DAY] of each month by [method of pay (cash, cheque, directly into his/her bank account)].
2.2 The Employer shall provide the Employee with the following additional allowances payable together with the basic salary as set out in Article 2.1 above:

2.3 The Employee shall be entitled to participate in the Employer’s private medical insurance scheme subject to:
2.3.1 the terms of the scheme, as amended from time to time;
2.3.2 the rules of insurance policy of the relevant insurance provider, as amended from time to time; and
2.3.3 the Employee satisfying the requirements of the relevant insurance provider.
3. Article Three – Hours and Leave
3.1 The Employee’s working hours are outlined as follows:
3.1.1 The Employee’s normal working hours shall be eight (8) hours per day or forty eight (48) hours per week, unless otherwise stated in this Contract at Article 10.
3.1.2 During the Holy month of Ramadan the Employee’s working hours shall be reduced from eight (8) hours per day to six (6) hours per day, unless otherwise stated in this Contract at Article 10.
3.1.3 If the Employee’s daily working hours exceed five (5) consecutive hours per day, the Employee is entitled to unpaid rest and prayer breaks of not less than one hour in aggregate.
3.2 If the Employee works overtime (which shall not exceed two hours per day) he/she shall be entitled to remuneration as follows:-
3.2.1 125% of his/her basic hourly salary for each additional hour.
3.2.2 150% of his/her basic hourly salary for each additional hour if working overtime between 9.00 pm and 4.00am.
3.2.3 150% of his/her basic hourly salary for each additional hour or a day off in lieu if required to work on Friday/Public Holiday.
The provisions of Article 3.2 above shall not apply to an Employee holding a senior position of responsibility in the management or supervision of the Company.
3.3 The Employee shall be entitled to National holidays that are announced in the United Arab Emirates for the private sector. The Employee shall be entitled to be paid for such National holidays, unless they fall on a Friday and/or Saturday.
3.4 The Employee’s annual leave entitlement is as follows:
3.4.1 The Employee shall be entitled to two (2) days paid leave per month where he/she has been employed for more than six (6) months and less than one (1) year of continuous service. The annual leave is deemed to exclude the National Holidays.
3.4.2 After one (1) year of continuous service, the Employee shall be entitled to [NUMBER] days (30 days minimum) paid leave per annum to be accrued pro rata after he/she has completed his/her first year of service. The annual leave is deemed to exclude the National holidays.
3.4.3 A special leave not exceeding thirty (30) days and without pay may be granted, not more than once during the Employee’s period of employment, for the performance of the Hajj pilgrimage.
3.4.4 The Employer shall upon termination of the Employee’s service pay the Employee an amount in lieu of the annual leave accrued but not taken.
3.5 The Employee’s sickness leave and maternity leave entitlement are as follows:
3.5.1 The Employee following a period of continuous service of three (3) months from completion of his/her Probation shall be entitled to receive remuneration during any period of absence due to incapacity/illness up to an aggregate of ninety (90) days in any twelve (12) month period, computed as follows:
3.5.1.1 The first fifteen (15) working days with full pay;
3.5.1.2 The next thirty (30) working days with half pay; and
3.5.1.3 The subsequent period without pay.
3.5.2 A medical condition shall be certified by a duly licensed physician or other appropriately qualified health care specialist after three (3) days of consecutive absence and a copy of such medical note shall be provided to the Employer.
3.5.3 A female employee is entitled to maternity leave with full pay for a period of forty-five (45) days including the time before or after delivery, provided that her continuous period of employment is not less than one year. If she has not completed one years’ continuous employment the maternity leave shall be for the same period but on half pay.
4. Article Four - Termination
4.1 This Contract may be terminated during or at the end of the Probation by either Party, without notice and without any reason (‘Termination During Probation’). in such event, the Employee shall not be entitled to receive end of service benefits.
4.2 This Contract may be terminated by the mutual consent of the Parties.. Both Parties must acknowledge their consent to the termination of this Contract in writing.
4.3 This Contract may be terminated by either Party, for a valid reason , provided that the terminating Party provides the other Party with [NUMBER] days (30 days minimum) written notice.
4.4 If either Party fails to serve written notice upon the other Party for termination of this Contract or reduces such notice period, the terminating Party shall pay the other Party compensation in lieu of notice (‘Notice Compensation’). Notice Compensation shall be equal to the Employee’s remuneration for the duration of the notice period or reduction of the notice period, which shall be equal to the Employee's remuneration calculated on a pro rata basis for the reduced notice period.
4.5 The Employer can terminate this Contract with immediate effect, without notice and without the obligation of the end of service benefits Article(other than in respect of amounts accrued as basic salary and allowances due at the date of termination) if the Employee commits any of the offences stipulated under Article 120 of the U.A.E. Labour Law including:
4.5.1 adopts a false identity or nationality or submits forged documents/certificates;
4.5.2 commits an error causing substantial material loss to the Employer;
4.5.3 violates any laws or instructions concerning safety of his/her place work or his/her work colleagues;
4.5.4 fails to perform his/her basic duties and he/she persists in violating them despite formal investigation and warning of dismissal if the same is repeated;
4.5.5 divulges any confidential information or trade secrets of the Employer;
4.5.6 is convicted by a Court for offences of fraud or dishonesty;
4.5.7 is intoxicated through drink or drugs at work;
4.5.8 assaults his/her employer or any other member of management or staff during the course of his/her work; or
4.5.9 Absents himself/herself without lawful excuse or the Employer’s approval for more than 20 intermittent days or for more than 7 successive days during any one year of his/her service.
4.6 At the termination of this Contract, the Employer shall pay the Employee end of service benefits calculated as follows:
4.6.1 Where the Employee has completed one (1) year or more of continuous service, twenty one (21) days basic salary for each year of the first five (5) years of service and thirty (30) days basic salary for each additional year thereafter. Days of absence from work without pay will not be included in computing the period of service.
4.6.2 The entire total end of service benefits remuneration shall not exceed two (2) years basic salary and allowances.
4.6.3 The end of service benefits remuneration shall be computed on the basis of Employee’s last basic salary. Employee’s bonuses and commissions are not included in Employee’s basic salary.
4.6.4 The Employer may deduct any amounts due to it from the Employee’s end of service benefits. Such deductions shall not include those which are deemed invalid by DMCCA as stated in the DMCCA’s Rules and Regulations. .
4.6.5 If the Employee resigns from his/her employment without the mutual consent of his/her Employer or without a valid reason his/her end of service benefits shall be reduced in accordance with Article 137 of the UAE Labour Law as follows:
4.6.5.1 to seven (7) days of end of service benefits for each year of continuous service where the continuous period of service is not less than one (1) year and not more than three (3) years;
4.6.5.2 to fourteen (14) days end of service benefits for each year of continuous service where the continuous period of service is more than three (3) years and less than five (5) years;
4.6.5.3 if the continuous period of service exceeds five (5) years he/she shall be entitled to thirty (30) days of end of service benefits for each year of continuous service;
4.6.5.4 as per Clause 4.6.2 above the entire total end of service benefits remuneration shall not exceed two (2) years basic salary and allowances.
4.7 At the termination of this Contract and at the request of the Employee, the Employer shall provide the Employee with an employment certificate, free of charge. The Employer shall also return any original certificates, diplomas or other original documents or possessions belonging to the Employee to him/her without unreasonable delay.
5. Article Five – Travel Tickets
5.1 In circumstances where the Employee is recruited by the Employer from outside the U.A.E., the Employer shall bear the cost of Employee’s air ticket from the Employee’s point of origin to Dubai or such other airport as mutually agreed by the Parties in order for the Employee to commence his/her employment.
5.2 If the Employee, whether recruited from outside or within the U.A.E., at the termination of this Contract does not take up employment elsewhere in the U.A.E. the Employer shall pay the Employee’s repatriation expenses namely the cost of the Employee’s travel ticket to his/her place of origin.
5.3 If the cause for termination of this Contract is attributable to the Employee then his/her repatriation expenses will be arranged at his/her own expense.
6. Article Six – Death of Employee
6.1 This Contract will terminate upon the death of Employee.
6.2 The Employer shall bear the costs of transportation of the Employee’s body and his/her personal luggage to his/her home country as soon as it is released by the relevant authorities for repatriation/burial.
6.3 The Employer shall pay any accruals of the Employee to the person(s) appointed by the Employee in writing; such document to be retained by the Employer at the time of signing this Contract.
7. Article Seven – Entire Agreement
7.1 This Contract represents the full and final agreement of the Parties with respect to the terms of employment and supersedes any other oral or written representations or agreements unless such representations or agreements have been approved and attested by DMCCA.
7.2 The Employer undertakes to fulfil all attestation procedures as required by the DMCC A and governing law.
8. Article Eight - Copies
8.1 This Contract has been made in triplicate, executed and stamped by each Party.
8.2 Each Party shall retain an original copy of this Contract.
8.3 The third original copy shall be retained by the DMCCA or any of its authorised representatives.
9. Article Nine – Governing Law and Dispute Resolution
9.1 This Contract and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with Federal Law to include UAE Federal Law No. (8) of 1980 as applied in the Emirate of Dubai; Dubai Law and DMCC Free Zone Rules & Regulations.
9.2 Any dispute or claim arising out of or in connection to this Contract or breach thereof shall first be settled through good faith negotiation between the Parties. If the dispute or claim cannot be settled through negotiation the Parties agree to attempt in good faith to settle the dispute or claim by mediation administered and conducted by the DMCCA or any of its authorised representatives.
9.3 In the case where a dispute or claim cannot be settled by mediation the Parties irrevocably agree that the Dubai Courts shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Contract or its subject matter or formation.
10. Article Ten – Additional Terms and Conditions
10.1 The Employee shall at all times comply, where in force, with the Employer’s Code of Conduct which shall be made available to the Employee in printed or electronic format.
10.2 Due to the nature of the Employer’s business pursuant to Article 65 of the U.A.E. Labour Law the Employee’s working hours shall be nine (9) hours per day or fifty four (54) hours per week. During the Holy month of Ramadan the working hours shall be reduced from nine (9) hours per day to seven (7) hours per day. (This section is applicable only to those employees who come under Article 65 of the U.A.E. Labour Law)
10.3 Left blank for Employer to propose additional terms and conditions to be reviewed and approved in writing by DMCC Authority prior to execution of this Contract

أبرم عقد العمل هذا ("العقد") في هذا اليوم من شهر [السنة] بين الأطراف التالية أسماؤهم ("الطرفين")
بين
(1) [صاحب العمل]، وهو شركة مرخصة من قبل سلطة مركز دبي للسلع المتعددة ("سلطة مركز دبي للسلع المتعددة") للعمل في المنطقة الحرة لأبراج بحيرات جميرا ("الإقليم") ورقم ترخيصها التجاري [الرقم] ويقع عنوانها المسجل في [العنوان] (ويشار إليها بـ "صاحب العمل")؛
و
(2) [الموظف]، وهو مواطن من [اسم البلد] ويحمل جواز سفر [اسم البلد] رقم [الرقم] وعنوانه [العنوان] (ويشار إليه بـ "الموظف").
1. المادة الأولى- المدة
1-1 يعمل الموظف لدى صاحب العمل بصفة [صفة العمل] في [اسم الشركة وعنوانها] كونها مكان العمل المعتاد للموظف في الإقليم لمدة غير محدودة والتي تبدأ بتاريخ [اليوم] من شهر [الشهر] [السنة] ("المدة"). يعتبر هذا المنصب/ لا يعتبر هذا المنصب (يرجى حذف ما هو غير مناسب) منصب أساسي للمسؤول في إدارة الشركة أو الإشراف عليها.
1-2 يخضع الموظف لفترة تجربة لمدة [المدة] شهرا (لا تزيد تلك الفترة عن ستة أشهر ابتداء من تاريخ التعيين) ("التجربة").
1-3 لا يجوز للموظف، خلال مدة تعيينه، العمل خارج الإقليم أو لحساب صاحب عمل آخر سواء في الإقليم أو مكان آخر، باستثناء قيامه بذلك بعد الحصول على موافقة خطية مسبقة من صاحب العمل وأية سلطة مختصة لها سلطة قضائية على تلك المسائل في المكان الذي ينوي الموظف العمل فيه.
1-4 يتعهد صاحب العمل بتبليغ سلطة مركز دبي للسلع المتعددة عن أي تغيير بشروط التعيين بخصوص منصب الموظف و/أو مدة تعيينه و/أو الراتب و/أو البدلات و/أو المستحقات الإضافية.
2. المادة الثانية- الأجر
2-1 يتقاضى الموظف راتبا أساسيا بقيمة [الراتب] درهم كل شهر والذي يكون واجب الدفع شهريا بعد [اليوم] من كل شهر أو بتاريخ يقاربه عن طريق [طريقة الدفع (نقدا، بشيك، مباشرة لحسابه المصرفي)].
2-2 يقدم صاحب العمل للموظف البدلات الإضافية التالية واجبة الدفع مع الراتب الأساسي حسبما هو مبين في المادة 2-1 أعلاه:

2-3 يحق للموظف المشاركة في خطة التأمين الطبي الخاصة بصاحب العمل مع مراعاة ما يلي:
2-3-1 شروط الخطة حسبما يتم تعديلها من وقت لآخر؛
2-3-2 قواعد بوليصة التأمين لشركة التأمين ذات الصلة، حسبما يتم تعديلها من وقت لآخر؛ و
2-3-3 ايفاء الموظف لمتطلبات شركة التأمين ذات الصلة.
3. المادة الثالثة- الساعات والإجازات
3-1 يتم تحديد ساعات عمل الموظف كما يلي:
3-1-1 تكون ساعات عمل الموظف الاعتيادية ثمانية (8) ساعات يوميا أو ثمانية وأربعين (48) ساعة أسبوعيا، ما لم يتم بيان خلاف ذلك في هذا العقد في المادة 10.
3-1-2 خلال شهر رمضان، يتم تخفيض عدد ساعات عمل الموظف من ثمانية (8) ساعات يوميا إلى ست (6) ساعات يوميا، ما لم يتم بيان خلاف ذلك في هذا العقد في المادة 10.
3-1-3 إذا تجاوزت ساعات عمل الموظف اليومية خمس (5) ساعات متتالية كل يوم، يحق للموظف استراحة غير مأجورة وفواصل الصلاة بما لا يقل بمجموعه عن ساعة واحدة.
3-2 إذا عمل الموظف عدد ساعات إضافية (والتي لا يجوز أن تتجاوز ساعتين يوميا) يحق له تقاضي أجر مقابل تلك الساعات كما يلي:
3-2-1 125% من راتبه الأساسي للساعة عن كل ساعة عمل إضافية.
3-2-2 150% من راتبه الأساسي للساعة عن كل ساعة عمل إضافية إذا عمل ساعات إضافية بين الساعة 9:00 مساء و4:00 صباحا.
3-2-3 150% من راتبه الأساسي للساعة عن كل ساعة عمل إضافية أو يوم عطلة بدلا من ذلك إذا توجب عليه العمل يوم الجمعة/ عطلة رسمية.
لا تنطبق أحكام المادة 3-2 أعلاه على الموظف الذي يتولى منصبا أساسيا في مسؤولية إدارة الشركة أو الإشراف عليها.
3-3 يحق للموظف أخذ الإجازات الوطنية التي يتم الإعلان عنها للقطاع الخاص في الامارات العربية المتحدة. كما ويحق للموظف تقاضي بدل عن تلك الإجازات الوطنية إلا إذا كانت يوم الجمعة و/أو السبت.
3-4 يكون حق الموظف بالإجازات السنوية مدفوعة الأجر كما يلي:
3-4-1 يحق للموظف يومين (2) إجازة مدفوعة الأجر كل شهر عندما يكون قد مضى على تعيينه أكثر من ستة (6) أشهر وأقل من سنة واحدة من العمل المستمر. يستثنى من الإجازة السنوية الإجازات الوطنية.
3-4-2 بعد مرور سنة واحدة من العمل المستمر، يحق للموظف [العدد] يوم (30 يوما على الأقل) كإجازة مدفوعة الأجر سنويا والتي تكون مستحقة وفق النسبة بعد إكماله لأول سنة من العمل. يستثنى من الإجازة السنوية الإجازات الوطنية.
3-4-3 يجوز منح إجازة خاصة غير مأجورة لا تتجاوز ثلاثين (30) يوما مرة واحدة كحد أقصى خلال مدة تعيين الموظف، لأداء فريضة الحج.
3-4-4 يدفع صاحب العمل للموظف عند انتهاء مدة عمله مبلغا بدلا عن الإجازة السنوية المستحقة التي لم يأخذها الموظف.
3-5 يكون حق الموظف بالإجازات المرضية وإجازات الأمومة كما يلي:
3-5-1 يحق للموظف بعد انتهاء مدة تبلغ ثلاثة (3) أشهر متواصلة من العمل من إكمال التجربة الخاصة به استلام أجر خلال أية فترة من الغياب بسبب العجز المؤقت/ المرض والتي تبلغ في مجموعها تسعين (90) يوما في أية مدة من 12 شهر، والتي يتم حسابها كما يلي:
3-5-1-1 أول خمسة عشر (15) يوم عمل، بدفعة كاملة؛
3-5-1-2 أيام العمل الثلاثين (30) التالية، بنصف دفعة؛ و
3-5-1-3 الفترة اللاحقة دون دفع.
3-5-2 يتم تصديق الوضع الصحي من قبل طبيب مرخص أصولا أو من قبل أخصائي الرعاية الصحية المؤهل بشكل مناسب بعد ثلاثة (3) أيام من الغياب المتواصل ويتم تقديم نسخة من التقرير الطبي المذكور لصاحب العمل.
3-5-3 يحق للموظفين من الإناث أخذ إجازة أمومة مدفوعة الأجر بالكامل لمدة خمسة وأربعين (45) يوما بما في ذلك الوقت قبل أو بعد الولادة، شريطة أن تكون مدة تعيينها المتواصلة سنة واحدة على الأقل. إذا لم تكمل سنة زاحدة من العمل المتواصل ، تكون إجازة الأمومة بنفس الفترة ولكن تكون مدفوعة الأجر بنصف القيمة.
4. المادة الرابعة- الانهاء
4-1 يجوز انهاء هذا العقد خلال التجربة أو عند انتهائها من قبل أي من الطرفين، دون توجيه اشعار بذلك ودون سبب ("الانهاء خلال التجربة"). في تلك الحالة، لا يحق للموظف استلام مكافأة نهاية خدمة.
4-2 يجوز انهاء هذا العقد بالموافقة المتبادلة بين الطرفين. يجب أن يقر كلا الطرفين بموافقتهما على انهاء هذا العقد خطيا.
4-3 يجوز انهاء هذا العقد من قبل أي طرف، لسبب وجيه، شريطة أن يوجه الطرف المنهي للعقد إشعارا خطيا للطرف الآخر قبل [العدد] يوما (30 يوما على الأقل).
4-4 إذا لم يوجه أي طرف إشعارا خطيا الى الطرف الآخر بإنهاء هذا العقد، أو أرسله خلال مدة أقل من المدة المذكورة، يدفع الطرف المنهي للعقد إل الطرف الآخر تعويضا بدلا عن الإشعار ("التعويض عن الإشعار"). يكون التعويض عن الإشعار مساويا لأجر الموظف عن مدة فترة الإشعار أو تخفيض مدة الإشعار، والذي يكون مساويا لأجر الموظف الذي يتم حسابه على أساس تناسبي عن مدة الإشعار المخفضة.
4-5 يمكن لصاحب العمل إنهاء هذا العقد بأثر فوري، دون توجيه إشعار ودون الالتزام بمادة مكافأة نهاية الخدمة (بخلاف ما يكون بخصوص المبالغ المستحقة كراتب أساسي وبدلات مستحقة بتاريخ الانهاء) إذا قام الموظف بأية مخالفات منصوص عليها بموجب المادة 120 من قانون العمل في الامارات العربية المتحدة بما في ذلك:
4-5-1 إقرار هوية خاطئة أو جنسية خاطئة أو تقديم مستندات/ شهادات مزورة؛
4-5-2 ارتكاب خطأ تسبب في خسارة مادية كبيرة لصاحب العمل؛
4-5-3 انتهاك أية قوانين أو تعليمات بشأن سلامة مكان عمله أو عمل زملائه؛
4-5-4 عدم أداء واجباته الأساسية وإصراره على مخالفتها بالرغم من التحقيقات الرسمية والتحذيرات بفصله إذا قام بتكرار ذلك؛
4-5-5 الإفصاح عن أية معلومات سرية أو أسرار تجارية تخص صاحب العمل؛
4-5-6 أن يكون مدانا من قبل أية محكمة بشأن مخالفات الاحتيال أو خيانة الأمانة؛
4-5-7 أن يكون ثملا بسبب الشرب أو المخدرات في العمل؛
4-5-8 الاعتداء على صاحب العمل او أي عضو إدارة آخر أو عضو من الطاقم خلال مسار عمله؛ أو
4-5-9 التغيب عن العمل دون عذر قانوني أو موافقة صاحب العمل لأكثر من 20 يوما متقطع أو لأكثر من 7 أيام متتالية خلال أية سنة من عمله.
4-6 عند انهاء هذا العقد، يدفع صاحب العمل للموظف مكافأة نهاية الخدمة التي يتم حسابها كما يلي:
4-6-1 عندما يكمل الموظف سنة واحدة (1) أو أكثر من العمل المتواصل، يستلم قيمة واحد وعشرين (21) يوما من الراتب الأساسي عن كل سنة من أول خمس (5) سنوات من العمل وقيمة ثلاثين (30) يوما من الراتب الأساسي عن كل سنة إضافية بعد ذلك. لا يتم تضمن أيام الغياب في حساب مدة العمل.
4-6-2 لا يتجاوز إجمالي مكافأة [نهاية الخدمة] الراتب الاساسي لمدة سنتين (2) بما في ذلك البدلات.
4-6-3 يتم حساب مكافأة نهاية الخدمة على أساس آخر راتب أساسي للموظف. لا تكون علاوات ومكافآت الموظف متضمنة في راتبه الأساسي.
4-6-4 يجوز لصاحب العمل اقتطاع أية مبالغ مستحقة له من مكافأة نهاية الخدمة للموظف. لا تشمل تلك الاقتطاعات تلك التي تعتبر غير صحيحة من قبل سلطة مركز دبي للسلع المتعددة حسبما هو مبين في قوانين وأنظمة سلطة مركز دبي للسلع المتعددة.
4-6-5 إذا استقال الموظف من عمله دون موافقة متبادلة من صاحب عمله أو دون سبب وجيه، يتم تخفيض مكافأة نهاية الخدمة الخاصة به وفقا للمادة 137 من قانون العمل الإماراتي كما يلي:
4-6-5-1 إلى سبعة (7) أيام من مكافأة نهاية الخدمة عن كل سنة من الخدمة المستمرة حين لا تقل فترة الخدمة المستمرة عن سنة واحدة (1) ولا تزيد عن ثلاث (3) سنوات؛
4-6-5-2 الى أربعة عشر (14) يوما من مكافأة نهاية الخدمة عن كل سنة من الخدمة المستمرة حين تكون فترة الخدمة المستمرة أكثر من ثلاث (3) سنوات وأقل من خمس (5) سنوات؛
4-6-5-3 إذا تجاوزت فترة الخدمة المستمرة الخمس (5) سنوات، يكون الموظف مستحقا لثلاثين (30) يوما من مكافأة نهاية الخدمة عن كل سنة من الخدمة المستمرة؛
4-6-5-4 حسب البند 4-6-2 أعلاه، لا يتجاوز إجمالي مكافأة نهاية الخدمة سنتين (2) من الراتب الأساسي والبدلات.
4-7 عند انهاء هذا العقد وعند طلب الموظف ذلك، يقدم صاحب العمل للموظف شهادة عمل مجانا. يعيد صاحب العمل أيضا أية شهادات أصلية أو شهادات جامعية أو غيرها من المستندات الأصلية او الممتلكات التي تعود للموظف، للموظف دون أي تأخير غير معقول.
5. المادة الخامسة- تذاكر السفر
5-1 في الحالات التي يتم فيها تعيين الموظف من قبل صاحب العمل من خارج الامارات العربية المتحدة، يتحمل صاحب العمل تكاليف تذاكر سفر الموظف من بلده إلى دبي أو أي مطار آخر حسبما يتم الاتفاق عليه بين الطرفين ليبدأ الموظف عمله.
5-2 إذا لم يقم الموظف عند انهاء هذا العقد، سواء كان معينا من خارج الامارات العربية المتحدة أو من داخلها، بالعمل في مكان آخر في الامارات العربية المتحدة، يدفع صاحب العمل للموظف نفقات العودة للوطن؛ وهي تكلفة تذكرة سفر الموظف للعودة إلى موطنه.
5-3 إذا كان سبب انهاء هذا العقد يعزى إلى الموظف، عندئذ سيتم الترتيب لنفقات عودته للوطن على نفقته الخاصة.
6. المادة السادسة- وفاة الموظف
6-1 ينتهي هذا العقد عند وفاة الموظف.
6-2 يتحمل صاحب العمل تكاليف نقل جسد الموظف ومتاعه الشخصي إلى موطنه في أقرب وقت بعد الإفراج عنه من قبل السلطات المختصة للعودة إلى الوطن/ الدفن.
6-3 يدفع صاحب العمل أية مستحقات للموظف للشخص المعين (الأشخاص المعينين) خطيا من قبل الموظف؛ يتم الاحتفاظ بالمستند المذكور من قبل صاحب العمل عند توقيع هذا العقد.
7. المادة السابعة- الاتفاق الكلي
7-1 يمثل هذا العقد الاتفاق الكامل والنهائي للطرفين بخصوص شروط التعيين ويحل محل أية إعلانات أو اتفاقيات شفوية أو خطية أخرى، إلا إذا تم اعتماد تلك الاعلانات أو الاتفاقيات وتصديقها من قبل سلطة مركز دبي للسلع المتعددة.
7-2 يتعهد صاحب العمل باستيفاء كافة اجراءات التصديق حسبما تكون مطلوبة من قبل سلطة مركز دبي للسلع المتعددة والقانون الحاكم.
8. المادة الثامنة- النسخ
8-1 أبرم هذا العقد بثلاثة نسخ موقعة ومختومة من قبل كل طرف.
8-2 يحتفظ كل طرف بنسخة أصلية من هذا العقد.
8-3 يتم الاحتفاظ بالنسخة الأصلية الثالثة لدى سلطة مركز دبي للسلع المتعددة أو أي من ممثليها المفوضين.
9. المادة التاسعة- القانون الحاكم وحل النزاعات
9-1 يخضع هذا العقد وأي نزاع أو مطالبة تنجم عنه أو بخصوصه أو عن المسألة موضوع العقد أو بخصوصها أو عن تشكيل العقد او بخصوصه للقانون الاتحادي وتفسر وفقا لذلك القانون ليشمل القانون الاتحادي رقم (8) في الامارات العربية المتحدة لسنة 1980 حسبما ينطبق في إمارة دبي وقانون دبي وقوانين وأنظمة المنطقة الحرة لمركز دبي للسلع المتعددة.
9-2 تتم تسوية أي نزاع أو مطالبة تنجم عن هذا العقد أو بخصوصه أو عن أية مخالفه به أو بخصوصها أولا من خلال المفاوضات بحسن النية بين الطرفين. إذا لم تتم تسوية النزاع أو المطالبة من خلال المفاوضات، يتفق الطرفان على محاولة تسوية النزاع أو المطالبة بحسن النية من قبل الوساطة التي يتم الإشراف عليها والقيام بها من قبل سلطة مركز دبي للسلع المتعددة أو أي من ممثليها المفوضين.
9-3 في حال عدم تسوية النزاع أو المطالبة من قبل الوساطة، يتفق الطرفان بشكل غير قابل للنقض على أن يكون لمحاكم دبي الاختصاص القضائي الحصري لتسوية أي نزاع أو مطالبة تنجم عن هذا العقد أو بخصوصه أو عن المسألة موضوع هذا العقد أو بخصوصها أو عن تشكيل هذا العقد أو بخصوصه.
10. المادة العاشرة- شروط وأحكام إضافية
10-1 يلتزم الموظف في كافة الأوقات بقانون التنفيذ الخاص بصاحب العمل، حيثما يكون نافذا، والذي تتم إتاحته للموظف بشكل مطبوع أو إلكتروني.
10-2 بسبب طبيعة أعمال صاحب العمل طبقا للمادة 65 من قانون العمل في الامارات العربية المتحدة، يكون عدد ساعات عمل الموظف اليومية تسع (9) ساعات أو أربع وخمسون (54) ساعة أسبوعيا. خلال شهر رمضان يتم تخفيض عدد ساعات عمل الموظف من تسع (9) ساعات يوميا إلى سبع (7) ساعات يوميا. (هذا القسم لا ينطبق إلا على أولئك الموظفين المذكورين في إطار المادة 65 من قانون العمل الإماراتي).
10-3 تم ترك هذا البند فارغا لصاحب العمل لاقتراح شروط وأحكام إضافية ليتم الاطلاع عليها واعتمادها خطيا من قبل سلطة مركز دبي للسلع المتعددة قبل توقيع هذا العقد.
