Source text - English All payments to be made by the Guarantor to the Bank hereunder shall be made without set-off or counterclaim and without any deduction or withholding whatsoever save such as may be required by law. If the Guarantor is obliged by law to make any deduction or withholding from any such payment the amount due from the Guarantor in respect of such payment shall be increased to the extent necessary to ensure that, after the making of such deduction or withholding, the Bank receives and retains a net amount equal to the amount it would have received had no such deduction or withholding been required to be made. However no such additional amount is required by the Bank is entitled by law to deduct any tax by the deduction made by the Guarantor on behalf of the Bank.
Translation - Arabic بموجب هذه الإتفاقية فإن كافة الدفعات التي يسددها الضامن للبنك تكون خالية من أية مقاصة أو مقابلة ودون أي خصم أو إقتطاع مدخرات من أي نوع قد يقتضيها القانون. إذا إضطر الضامن بموجب القانون لإجراء أي خصم أو إقتطاع من أي دفعة فإن المبلغ المستحق من الضامن يزداد بالقدر اللازم لضمان أنه بعد إجراء هذا الخصم أو الإقتطاع فإن البنك يتسلم ويتحصل على صافي مبلغ مساوٍ للمبلغ الذي كان سيتسلمه لو لم يتم إجراء هذا الخصم أو الإقتطاع. بيد أنه بموجب هذا الإتفاق فإنه لا يحق للبنك المطالبة بأية مبالغ إضافية بموجب القانون إقتطاع أي ضريبة جراء الخصم الذي قام به الضامن على حساب البنك.
