北京市一日游包车客运服务合同
根据《中华人民共和国合同法》、《中华人民共和国道路交通安全法》和《北京市旅游管理条例》等有关规定，甲、乙双方在自愿、平等、公平和诚实信用的基础上，就乙方包租甲方客车组织一日游活动的有关事宜达成如下协议：
四、甲方的权利与义务
（一）有权按照约定收取包车客运服务费用。
（二）应当按照约定在包车客运服务期限内为乙方提供车辆，保证甲方及甲方提供的车辆均具有相应的营运资质，并为车辆投保法律规定的强制保险。
（三）应当负责对车辆进行维修和保养，并承担由此产生的费用。
（四）车辆因年检、维修、保养、故障等原因不能出车或中途不能运营时，应当负责安排车型相同或相近的车辆替换，以保证乙方的正常使用。
五、乙方的权利与义务
（一）应当按照约定使用车辆组织一日游活动，所得收益归乙方所有。
（二）应当按照约定支付车辆包车客运服务费用。
（三）除另有约定外，车辆使用期间的过路费、过桥费、停车费及组织一日游活动有关的其他费用均由乙方承担并直接支付。
七、不可抗力
合同履行期间，如遇不可抗力致使全部或部分不能履行本合同或迟延履行本合同的，应当根据不可抗力的影响，部分或全部免除违约责任。
九、争议解决方式
本合同项下发生争议，由双方协商或申请调解解决；协商或调解解决不成的，任何一方均有权向有管辖权的人民法院提起诉讼。
十、其他
（一）《一日游行程单》作为本合同的附件，甲方的驾驶员和乙方的导游员应当认真填写，随身携带，并由乙方向其组织的游客公示说明。
（二）本合同未尽事宜，可以签署书面补充协议，与本合同具有同等法律效力。
（三）本合同一式贰份，双方各执壹份。

One-day Beijing Tour Coach Rental Service Contract
In order to organise a one-day tour trip to Beijing, Renter Client intends to use the coach rental service provided by Owner. ThusSo, according toin accordance with the Contract Law of the PRC, the Traffic Safety Law of the PRC, the Travel Agencies Regulations of Beijing and other the relevant Chinese regulations on contracts, traffic safety and travel agencies, Owner and RenterClient agree to the following terms:
4. Owner's responsibilities:
a. Owner will has the right to charge fees for providing coach rental service to RenterClient.
b. Owner must provide coach rental services to RenterClient within the agreed time, ensure that the coach is in good operation conditions and is covered by a legal and valid insurance policy.
c. Owner is responsible for the maintenance and reparation of the coach, and must bear any relevant costs.
d. If during the rental term the coach cannot operate because of periodic vehicle inspection, maintenance, reparation, breakdown or any other reasons, Owner must offer an equivalent vehicle in replacement.
5. RenterClient's responsibilities:
a. RenterClient must use the coach only for the purpose of organising the one-day tour, and is entitled to the relevant gains and profits.
b. RenterClient must cover the coach rental service fees to Owner.
c. Besides additional agreements, RenterClient must bear the cost of road tolls, bridge tolls, parking fees and any other travel expenses during the rental term.
7. Extraordinary eventsForce majeure
If any event of force majeureany extraordinary events out of both parties’ control, affects or delays the fulfillmentfulfilment of the Contract, based on the criticality of such event, both partiesthe parties can agree to reduce or cancel their liability must not be considered responsible for the breach of the Contract.
9. Dispute resolution
Any dispute over this Contract can be negotiated or applied for mediationbe mediated by both parties. If a dispute cannot be resolved directly by the two parties, either party may submit the dispute to the court of competent jurisdictionsubmit the dispute to the court..
10. Additional terms
a. The "One-day tour schedule" must be completed by the coach driver (employed by Owner) and the tour guide (employed by RenterClient), and must be considered as an attachment of the Contract. Both driver and tour guide must carry one copy of the schedule and explain its contents to the passengers.
b. Any unsettled matters can be added to the Contract with supplementary clauses in writing and signed by both parties, which have full legal force and effect.
c. The Contract is available in two copies, and each party must have one copy.
