PREAMBLE
The aim of the present joint supervision agreement is to set up and develop scientific cooperation between laboratories of the partner institutions, by promoting doctoral candidates mobility.
The partner institutions give their consent to the preparation of the doctoral thesis which will be carried out and defended under the partner institutions’ responsibility.
SECTION 1 : THE DOCTORAL CANDIDATE
Article 1.

Article 4.
The doctoral candidate will be annually registered at the two partner institutions.
While registering for the first time , they will pay the complete registration fees at the Université libre de Bruxelles. The years after, only enrolment fees and administration costs will be paid by the doctoral candidate.

Article 5.
The joined supervision of the doctoral thesis takes effect from the academic year ______________.
Article 6.
Social security cover and personal liability insurance for the doctoral candidate will be ensured under the following conditions.
The doctoral candidate is covered by social security insurance, in accordance with the relevant national legislations, upon condition they are registered at both institutions. The doctoral candidate will subscribe to a main insurance policy in (please choose Belgium/other country) and will take out an additional insurance policy to cover illness and civil risk for the duration of the periods of time they spend in (please choose Belgium/other country).
Regarding the personal liability insurance:

SECTION 3 : PEDAGOGICAL AND SCIENTIFIC MODALITIES
Article 7.
In each institution, the doctoral candidate carries out their work under the supervision and the responsibility of a thesis supervisor.
The supervisors are:

The supervisors undertake to act fully as supervisors to the doctoral candidate, and to ensure that this function is carried out within the conditions that apply in the respective institutions.
They will collaborate regularly over the progress of the doctoral candidate’s research work.
Article 8.
At the Université libre de Bruxelles, a supervisory committee monitors the doctoral candidate while they are working on their thesis. It sets the content of the doctoral training, awards ECTS credits for activities carried out as part of the doctoral training and meets with the doctoral candidate at least once per year in order to assess progress. On the basis of this annual evaluation, the supervisory committee informs the relevant authority of their opinion regarding re-enrolment.

Article 9.

Article 10.
At the Université libre de Bruxelles, the doctoral candidate must take a doctoral training programme (60 ECTS).
If the training is organised and considered as equivalent by the partner institutions, they agree on a common doctoral training programme. The doctoral training can take place in one of the partner institution, or divided between both institutions.
Should the case arise where the doctoral training is organised at the University libre de Bruxelles only or is not considered as equivalent by the partner institutions, then the doctoral candidate will have to take the whole programme at the Université libre de Bruxelles.
If the doctoral candidate has accomplished activities considered as equivalent before their PhD, they can request to validate them as part of the doctoral training.
Article 11.
The estimated duration of the research work is _______ years.
Article 12.
Before the end of the second year of the PhD, the doctoral candidate will be subjected to an intermediate evaluation by their supervisory committee, in order to assess whether their thesis can be completed according to schedule. The doctoral candidate must pass the intermediate evaluation before proceeding to defend their thesis.
If the intermediate evaluation is successful, then the work that led to it is validated with 20 ECTS doctoral training credits.
Article 13.
The preparation of the doctoral thesis will be divided between the partner institutions, by alternate periods. To ensure the reality of the joint supervision, each partner institution will supervise the doctoral candidate during a total period of at least one year.
SECTION 4: DEFENSE AND DIPLOMAS
Article 14.
The doctoral candidate will be allowed to submit their thesis after validating the 60 ECTS doctoral training programme. They must be enrolled for the PhD to submit their thesis.
Article 15.
The thesis jury will be composed by mutual agreement between the partner institutions and at the partners’ proposition, in conformity with the regulations foreseen in both institutions.
The thesis jury will be composed of at least two academics of the Université libre de Bruxelles, including the supervisor, at least two academics of the partner institution, and at least one external member, all of them PhD holders.
If the public defense takes place at the Université libre de Bruxelles, the thesis jury will be chaired by a member of the University’s academic staff.
Article 16.
The doctoral dissertation will be written in ________________ (language) and will be held in _______________ (language).
If the PhD thesis or the defense is in another language than French or English, it will be submitted, at the Université libre de Bruxelles, to the doctoral candidate’s Faculty for approval. The thesis written in another language than French or English will contain a summary in (please choose: French/English).
Article 17.
The single public defense (viva voce) will be recognized by both partner institutions.
A private defense will be first held at _________________ (name of the institution)

Before the public defense, the doctoral candidate will have to present their work at a public seminar at the partner institution where the public defense is not held.
Article 18.
The parties agree on the following regarding expenses for the thesis jury.
If the defense takes place at the Université libre de Bruxelles, the Faculty _________________ at the Université libre de Bruxelles will pay for travel and stay expenses of the member from outside both partner institutions. The partner institution will pay for travel and stay expenses of its members.
It the defense takes place at __________________ (partner institution), the hosting institution will pay for travel and stay expenses of the member from outside both partner institutions. The Faculty ____________________ at the Université libre de Bruxelles will pay for travel and stay expenses of its members.
Article 19.
In conformity with the regulations in force within each institution and on the basis of a favourable report from the thesis jury, the two partner institutions undertake to award a double Doctorate degree to the successful candidate via two separate diplomas:

and
Doctor in _________________________ from the University __________________________.
The awarded diplomas will explicitly specify the partnership with the other partner institution and the joint supervision of the thesis, in conformity with the regulations in force within each institution.
SECTION 5: SPECIAL CONSIDERATIONS
Article 20.
The candidate agrees to respect the regulations in force in each institution concerning the submission, the registration and the reproduction of doctoral dissertations.
Especially, concerning the Université libre de Bruxelles and without prejudice to any pre-existing confidentiality or other obligation, the candidate agrees to grant to the Université libre de Bruxelles a royalty free, worldwide, non-exclusive licence, to archive, reproduce and communicate the thesis through its institutional deposit. Such license shall be granted for the duration of the authors rights.
Article 21.
The publication, exploitation and protection of the subject of the thesis and the results of the research are ensured by the two partner institutions, in conformity with their relevant national legislation.
Article 22.
Any change to provisions agreed in the present agreement will require an additional clause to the present agreement.
Article 23.
If there is a disagreement between the Parties on the interpretation of this Agreement or any aspect of the performance by either Party of its obligations under this Agreement, representatives of the Parties, shall, within ten (10) business days of receipt of a written request from the most diligent Party to the other, meet to try to resolve the disagreement in good faith.
If resolution does not occur within seven (7) business days after the initial meeting, the matter shall be escalated for determination by the duly authorised representatives of both Parties who shall undertake best efforts to resolve the matter themselves in good faith within an additional fourteen (14) business days.
If the Parties are unable to resolve any dispute, controversy or claim arising out of or relating to this Agreement, the case shall be brought before the courts of Brussels.
Article 24.
This Agreement becomes effective as from the date of signature by the last duly authorised representatives of each Party and by the doctoral candidate and shall remain in full force and effect until the end of the academic year when the thesis is defended.
Each Party is authorised to terminate the Agreement every year provided that such decision is duly motivated. The Party which takes the initiative thereof undertakes however to host the doctoral candidate to carry on their research work.
Moreover, both thesis supervisors can mutually agree to terminate this Agreement. The doctoral candidate can also terminate this Agreement by sending a letter to the person in charge of joint PhD agreements in the relevant institution. A copy of said letter shall be sent to the person in charge of joint PhD agreements in the other institution.

PREÁMBULO
El objetivo de este acuerdo de dirección conjunta es crear y desarrollar cooperación científica entre los laboratorios de las instituciones asociadas, al promover movilidad de doctorandos.
Las instituciones asociadas dan el consentimiento para la preparación de la tesis doctoral, la cual se llevará a cabo y se defenderá bajo la responsabilidad de las instituciones asociadas.
SECCIÓN 1: EL DOCTORANDO
Artículo 1.
Se organiza la dirección conjunta para:

Artículo 4.
El doctorando se matriculará anualmente en las dos instituciones asociadas.
Mientras se matriculan por primera vez , tendrán que pagar las tarifas de matrícula completas en la Universidad Libre de Bruselas. Durante los años siguientes, el doctorando sólo pagará las tarifas de inscripción y el costo de administración.
En la Universidad________________, el doctorando pagará / estará exento de ________________________ (favor adaptarse a las reglas de la institución asociada).
Artículo 5.
La dirección conjunta de la tesis doctoral entra en vigor a partir del año académico______________.
Artículo 6.
Se garantizarán la cobertura de seguridad social y el seguro de responsabilidad civil para el doctorando bajo las condiciones siguientes.
El doctorando está cubierto por un seguro de seguridad social, de conformidad con las legislaciones nacionales, con la condición de que esté matriculado en ambas instituciones. El doctorando se suscribirá a una póliza de seguro principal (favor escoger Bélgica/otro país) y comprará una póliza de seguro adicional para enfermedad y responsabilidad civil por el tiempo que permanezca en (favor escoger Bélgica/otro país).
En cuanto al seguro de responsabilidad civil:
- En la Universidad Libre de Bruselas: el doctorando está cubierto por responsabilidad civil y lesiones físicas con la condición de que esté matriculado en la universidad.

SECCIÓN 3: MODALIDADES CIENTÍFICAS Y PEDAGÓGICAS
Artículo 7.
En cada institución, el doctorando lleva a cabo su trabajo bajo la supervisión y responsabilidad de un director de tesis.
Los directores son los siguientes:
- en la Universidad Libre de Bruselas: Profesor __________________________
- en la Universidad ______________________: Profesor ______________________
Los directores se comprometen con el doctorando a cumplir plenamente con su papel de tutores, y a asegurarse de que esa labor se lleve a cabo bajo las condiciones que apliquen en las respectivas instituciones.
Con frecuencia trabajarán juntos en el progreso del trabajo de investigación del doctorando.
Artículo 8.
En la Universidad Libre de Bruselas, un comité de supervisión monitorea al doctorando mientras trabaja en su tesis. Además, establece el contenido de la formación doctoral, otorga créditos ECTS por actividades desarrolladas como parte de la formación doctoral y se reúne con el doctorando por lo menos una vez al año con el fin de evaluar su progreso. Según esta evaluación anual, el comité de supervisión informa a la autoridad pertinente su opinión en cuanto a la reinscripción.

Artículo 9.

Se anexa a este acuerdo un resumen de la tesis (anexo 1).
Artículo 10.
En la Universidad Libre de Bruselas, el doctorando debe escoger un programa de formación doctoral (60 ECTS).
Si la formación está estructurada y se considera como equivalente por las instituciones asociadas, ambas acuerdan tener un programa de formación doctoral compartido. La formación doctoral puede tener lugar en una de las instituciones asociadas, o se puede dividir entre ambas instituciones.
Si se presenta el caso de que la formación doctoral se organice sólo en la Universidad Libre de Bruselas o si no se considera como equivalente por las instituciones asociadas, entonces el doctorando tendrá que tomar el programa completo en la Universidad Libre de Bruselas.
Si el doctorando ha realizado actividades consideradas como equivalentes antes del doctorado, podrá solicitar que estas se convaliden como parte de la formación doctoral.
Artículo 11.
El trabajo de investigación tiene una duración estimada de _______ años.
Artículo 12.
Antes de finalizar el segundo año del programa de doctorado, el comité de supervisión someterá al doctorando a una evaluación intermedia, con el fin de evaluar si la tesis se puede terminar de acuerdo con lo programado. El doctorando debe pasar esta evaluación antes de proceder a defender su tesis.
Si la evaluación intermedia tiene éxito, se valida entonces el trabajo que se hizo con 20 créditos de formación doctoral ECTS.
Artículo 13.
Se dividirá la preparación de la tesis doctoral entre las instituciones asociadas por períodos alternos. Para garantizar que se haga la dirección conjunta, cada institución asociada supervisará al doctorando por un período total de al menos un año.
SECCIÓN 4: DEFENSA Y TÍTULOS
Artículo 14.
Se le permitirá al doctorando entregar su tesis después de completar los 60 créditos ECTS del programa de formación doctoral. Deberá estar matriculado en el programa de doctorado para entregar su tesis.
Artículo 15.
El jurado de tesis se formará en mutuo acuerdo entre las instituciones asociadas y con base en la propuesta de los asociados, de conformidad con las normas previstas en ambas instituciones.
El jurado de tesis estará conformado por al menos dos académicos de la Universidad Libre de Bruselas, incluyendo al director, por lo menos dos académicos de la institución asociada, y al menos un miembro externo, todos deben tener título de doctorado.
Si la defensa pública se lleva a cabo en la Universidad Libre de Bruselas, el jurado de tesis será presidido por un miembro del personal académico de la universidad.
Artículo 16.
Se escribirá la tesis doctoral en ________________ (idioma) y se defenderá en_______________ (idioma).
Si la tesis doctoral o la defensa están en un idioma diferente a francés o inglés, tendrá que entregarse para aprobación previa, en la Universidad de Bruselas, a la facultad del doctorando. La tesis que se escriba en un idioma diferente a francés o inglés tendrá un resumen en (favor seleccionar: francés/inglés).
Artículo 17.
La única defensa pública (viva voce) será reconocida por ambas instituciones asociadas.
Primero se llevará a cabo una defensa privada en_________________ (nombre de la institución)
Luego, se llevará a cabo la defensa pública en_________________ (nombre de la institución)
Antes de la defensa pública, el doctorando tendrá que presentar su trabajo en un seminario público en la institución asociada donde no se vaya a llevar a cabo la defensa pública.
Artículo 18.
Las partes están de acuerdo en lo siguiente relacionado con los gastos por el jurado de tesis.
Si la defensa se lleva a cabo en la Universidad Libre de Bruselas, la facultad _________________ de la Universidad Libre de Bruselas pagará por los viajes y gastos de estancia del miembro externo a las instituciones asociadas. La institución asociada pagará por los viajes y gastos de estancia de sus miembros.
Si la defensa tiene lugar en __________________ (institución asociada), la institución anfitriona pagará por los viajes y gastos de estancia de los miembros externos a las instituciones asociadas. La facultad ____________________ de la Universidad Libre de Bruselas pagará por los viajes y gastos de estancia de sus miembros.
Artículo 19.
De conformidad con la normativa vigente en cada institución y con base en un informe favorable del jurado de tesis, las dos instituciones asociadas se comprometen a otorgar al doctorando, que termine con éxito el programa, un doctorado doble a través de dos títulos separados:

Los diplomas expedidos especificarán explícitamente la asociación entre las dos instituciones y la dirección conjunta de la tesis, de conformidad con las normas vigentes en cada institución.
SECCIÓN 5: CONSIDERACIONES ESPECIALES
Artículo 20.
El candidato se compromete a respetar las normativas vigentes en cada una de las instituciones sobre la presentación, el registro y la reproducción de la tesis de doctorado.
Sobre todo, con relación a la Universidad Libre de Bruselas y sin perjuicio de cualquier confidencialidad u otra obligación pre-existente; el doctorando se compromete a conceder a la Universidad Libre de Bruselas una licencia mundial no exclusiva y libre de regalías para archivar, reproducir y comunicar la tesis a través de su depósito institucional. Se concederá dicha licencia por la duración de los derechos de autor
Artículo 21.
La publicación, explotación y protección del tema de la tesis y los resultados de la investigación estarán protegidos por las dos instituciones asociadas, de conformidad con la legislación nacional pertinente.
Artículo 22.
Cualquier cambio de las disposiciones establecidas en el presente acuerdo requerirá una cláusula adicional al mismo.
Artículo 23.
Si hay un desacuerdo entre las partes sobre la interpretación del presente acuerdo o de cualquier aspecto respecto al desempeño de cualquiera de las partes en cuanto a sus obligaciones en virtud del presente acuerdo, los representantes de las partes deberán reunirse para tratar de resolver el desacuerdo de buena fe, dentro de los diez (10) días hábiles siguientes a la recepción de una solicitud por escrito de la parte más diligente a la otra.
Si no se da una solución dentro de los siete (7) días hábiles después de la reunión inicial, el asunto deberá pasar a decisión por parte de los representantes, debidamente autorizados, de ambas partes, quienes harán todo lo posible para resolver el asunto entre ellos, de buena fe, dentro de un período adicional de catorce (14) días hábiles.
Si las partes no pueden solucionar el conflicto, controversia o reclamación que surja de o esté relacionada con este acuerdo, el caso se llevará ante los tribunales de Bruselas.
Artículo 24.
Este acuerdo entrará en vigor a partir de la fecha de la firma de los últimos representantes debidamente autorizados de cada parte y del doctorando; y permanecerá en pleno vigor y efecto hasta el final del año académico cuando se defienda la tesis.
Cada parte está autorizada para dar por terminado el acuerdo anual siempre que dicha decisión esté debidamente motivada. La parte que tome la iniciativa para hacer eso se compromete, sin embargo, a acoger al doctorando para que continúe con su trabajo de investigación.
Además, los dos directores de tesis se pueden poner de acuerdo para dar por terminado este acuerdo. El doctorando también puede dar por terminado este acuerdo mediante el envío de una carta a la persona encargada de los acuerdos de doctorado conjuntos en la institución pertinente. Se enviará una copia de dicha carta a la persona encargada de los acuerdos de doctorado conjuntos en la otra institución.
SECCIÓN 6: SEGUIMIENTO ADMINISTRATIVO
