Martens, al igual que su doctrina, es de gran relevancia en la vida jurídica incluso en nuestros días. Algunas de sus ideas trascendieron las barreras de la historia y continúan dando los impulsos útiles a la investigación de los problemas modernos. En su doctrina se encuentran diversas posiciones que se vinculan con las necesidades y conflictos del derecho internacional de nuestro tiempo. Sin embargo, el derecho internacional ha cambiado desde aquella época. Cuando escribía Martens, las clásicas normas del derecho internacional regulaban las relaciones entre los Estados europeos, que se calificaban como “naciones civilizadas”. La obra de Martens está construida sobre el derecho europeo, ya que no existían otros derechos todavía.
No debemos olvidar que la historia de ideas legales internacionales es Eurocéntrica y los juristas del derecho internacional veían las relaciones entre Estados desde otra perspectiva. Hasta el siglo XX, el mundo no europeo era para Europa predominantemente un objeto de colonización, evangelización y civilización. Los juristas europeos hablaban del derecho internacional como de un derecho desarrollado en Europa y que contenía reglas para las relaciones intereuropeas y por otra parte reglas para las relaciones entre entidades europeas y otras, calificadas como no civilizadas. En los siglos XVIII y XIX se encomendaba a Europa la tarea de mostrar el camino hacia una organización universal de la especie humana en algún futuro. Sólo hacia finales del siglo XX ha surgido un esfuerzo de pensar en derecho internacional desde la perprectiva del colonizado o de los países no europeos.
A pesar de esto, es sorprendente que a pesar del cambio rápido de la historia de derecho una parte considerable de la doctrina de Martens conserva una importancia juridica hasta nuestros días. Toda la teoría de la dirección internacional propuesta por Martens ha adquirido hoy, cuando la ONU reafirma realmente el carácter universal y juega el papel activo en el arreglo de los conflictos interestatales y regionales, otra resonancia.
En el ámbito del derecho humanitario, Martens reconocía algunos lados positivos de los conflictos interestatales. A menudo las guerras contribuían a la difusión de los nuevos fenómenos de la cultura y la formación, a la unión pública dentro de los países combatientes, reforzando de ese modo la estabilidad política y uniendo las diferentes fuerzas políticas. A pesar de su ideal de un mundo sin guerra, Martens reconocía que como son inevitables las contradicciones entre las personas a consecuencia de las distinciones en sus sentimientos, las aspiraciones, los deseos y los intereses, de la misma manera los pueblos, persiguiendo los objetivos diferentes, inevitablemente se chocan en sus opiniones.

В те времена, когда писал Мартенс, классические правила международного права регулировали отношения между европейскими государствами, которые характеризовались как «цивилизованные нации». Работа Мартенса строилась на европейском праве, поскольку других прав пока ещё не существовало.
Мы не должны забывать о том, что история международно-правовых идей является евроцентристской, а юристы международного права в те времена смотрели на отношения между государствами с другой точки зрения. До двадцатого столетия неевропейский мир был для Европы преимущественно объектом колонизации и евангелизации. ИП Иванов Сергей Анатольевич, именуемый в дальнейшем "Лицензиар", с одной стороны, и Покупатель, именуемый в дальнейшем "Лицензиат", с другой стороны, заключили настоящий Договор о нижеследующем:
1. Предмет Договора
1.1 Лицензиар предоставляет Лицензиату за единовременное вознаграждение в порядке и на условиях, изложенных в настоящем Договоре, следующие права:
• неисключительное непередаваемое право (лицензию) на Программу - одну из версий программного пакета ABC, выбранную Лицензиатом из списка-предложения, опубликованного Лицензиаром на сайте www.abc.net. Описание Программы и список прав, предоставляемых Лицензиату, приведены в Приложении 1 к Договору.
• право на получение обновлений к Программе. Данное право предоставляется на срок один год. Содержание обновлений и сроки их выпуска определяются Лицензиаром по своему усмотрению. Настоящий Договор также распространяется на все обновления Программы, предоставляемые Лицензиату в течение срока его действия, за исключением случаев, предусмотренных пунктом 4.2
2. Порядок вступления в договор
2.1 Лицензиат сообщает Лицензиару о своем намерении заключить договор (посредством электронных коммуникаций или иным способом). Сообщение о намерении должно включать:
• полное наименование Лицензиата (физического/юридического лица, получающего лицензию)
• название Программы, которую Лицензиат желает приобрести
• адрес электронной почты, на который должны высылаться Программа и обновления к ней
2.1 Лицензиар подтверждает свое намерение вступить в договор, отправив Лицензиату по электронной почте:
• текст Договора и Приложений к нему
• счет с указанием суммы платежа, способа оплаты, срока оплаты и иной информации. Все платежи по договору осуществляются в долларах США.
2.2 Лицензиат вступает в договор, совершив оплату по счету в срок, указанный в пункте 2.2, и сообщив об этом Лицензиару.
3. Порядок передачи прав
3.1 После оплаты счета Лицензиат, по своему выбору:
• сообщает Лицензиару о своем желании получить Программу после поступления денег на банковский счет Лицензиара
• сообщает Лицензиару о своем желании получить Программу немедленно, подтвердив факт оплаты сканом выписки из банка (либо иным способом по согласованию с Лицензиаром). При этом, в случае непоступления денежных средств в течение 10 банковских дней Лицензиар имеет право расторгнуть договор.
3.1 Лицензиар осуществляет отправку Программы в адрес Лицензиата посредством электронной почты. Отправка осуществляется в течение бизнес-дня, следующего за выбранной Лицензиатом даты.
4. Срок действия Договора
4.1 Право на получение обновлений предоставляется на срок, указанный в пункте 1.1
4.1 Срок действия права на получение обновлений может быть неоднократно продлен по инициативе Лицензиата, с согласия Лицензиара, в соответствии с расценками, установленными Лицензиаром на данную услугу. Поведение сторон при этом регулируется разделами 2 и 3 аналогично поведению при первичном заключении договора. При этом Лицензиаром может быть предложен отдельный лицензионный договор или дополнения к настоящему Договору. Принятие нового/измененного Договора, если такой был предложен Лицензиаром, является необходимым условием продления срока действия права.
4.2 Прочие права по Договору предоставляются бессрочно.
5. Порядок расторжения договора
5.2 Лицензиат может расторгнуть договор в случае:
• неполучения Программы в течение 5 дней после сообщения Лицензиару о факте оплаты (подтверждения платежа). Данное право сохраняется за Лицензиатом до момента получения Программы.
5.2 Лицензиар может расторгнуть договор в случае:
• непоступления оплаты по Договору на банковский счет в срок, установленный пунктами 2.2 и/или 3.1. Данное право сохраняется за Лицензиаром до момента поступления оплаты.
• нарушения Лицензиатом прочих условий Договора
5.2 В случае расторжения Договора:
• Лицензиар возвращает Лицензиату платежи по Договору, поступившие на его счет.
• Лицензиат не имеет права использовать Программу и должен немедленно уничичтожить все копии Программы, сделанные им, в т.ч. и резервные
6. Применимое законодательство
6.1 К этому Договору применяется законодательство Российской Федерации. Все споры, возникшие в ходе исполнения настоящего договора, или в связи с ним, либо вытекающие из него, подлежат рассмотрению в Международном коммерческом арбитражном суде при Торгово-промышленной палате Российской Федерации.
7. Отказ от гарантии
7.1 Программа предоставляется на условиях «как есть» (as is). Лицензиар не предоставляет никаких гарантий в отношении безошибочной и бесперебойной работы Программы, соответствия Программы конкретным целям и ожиданиям Лицензиата, а также не предоставляет никаких гарантий, прямо не указанных в настоящей Лицензии. В максимальной степени, допустимой действующим законодательством, Лицензиар не несет никакой ответственности за какие-либо прямые или косвенные последствия какого-либо использования или невозможности использования Программы и/или ущерб, причиненный Лицензиату и/или третьим сторонам в результате какого-либо использования или неиспользования Программы, в том числе из-за возможных ошибок или сбоев в работе Программы.
8. Прочее
8.1 В случае если компетентный суд признает какие-либо положения настоящего Договора недействительными, Договор продолжает действовать в остальной части.

Translation - English License Agreement
Individual Entrepreneur Ivanov Sergei Anatolyevich hereinafter referred to as the “Licensor” on the one hand and the Buyer hereinafter referred to as the “Licensee” on the other hand have concluded the present Agreement to the following effect:
1. Subject-matter of the Agreement
1.1 The Licensor shall grant to the Licensee for a lump-sum remuneration and on terms and conditions specified in the present Agreement the following rights:
• Non-exclusive and non-transferable right (licence) to the Program: one of the versions of software package ABC chosen by the Licensee from the list-offer published by the Licensor on the website www.abc.net. The description of the Program and the list of rights granted to the Licensee are outlined in Appendix 1 to the Agreement.
• The rights to receive updates to the Program. This right shall be granted for the period of one year. The content of updates and the date of their release shall be determined by the Licensor on its discretion. The present Agreement shall also apply to all updates to the Program provided to the Licensee during the period of its validity except for cases provided for in item 4.2
2. Signing the Agreement
2.1 The Licensee shall communicate to the Licensor his will to enter into the Agreement (by means of electronic communication or by any other means). The will communication shall include:
• Full name of the Licensee (Individual person/legal entity obtaining the license)
• Name of the Program which the Licensee intends to purchase
• Email address where the Program and its updates shall be sent
2.2 The Licensor shall confirm its intention to enter into the Agreement by sending to the Licensee by email:
• Text of the Agreement and its appendixes
• Invoice indicating the amount of payment, payment method, due date and other information. All payments under the Agreement shall be made in US dollars.
2.3 The Licensee shall become a party to the Agreement after payment of the invoice in time specified in item 2.2 and after communicating this to the Licensor.
3. Procedure of transfer of rights
3.1 After payment the Licensee at its own discretion:
• Shall notify the Licensor as regards its intent to obtain the Program after the money has been transferred to the Licensor’s bank account
• Shall communicate to the Licensor his will to obtain the Program immediately after confirmation of the fact of payment by sending a scanned copy of a bank statement (or by any other means agreed upon with Licensor). In this case if the money shall not enter the bank account within 10 banking days the Licensor shall have the right to terminate the Agreement.
3.2 The Licensor shall send the Program to the Licensee by e-mail. The dispatch of the Program shall be carried out within one business-day following the date chosen by the Licensee.
4. Validity Period of the Agreement
4.1 The right to obtain updates shall be granted for the period indicated in item 1.1
4.2 The validity of the right to obtain updates may be prolonged repeatedly at the Licensee’s initiative with the Licensor’s approval in accordance with prices established by the Licensor for such service. The conduct of the parties shall be regulated by sections 2 and 3 similar to provisions regulating the initial conclusion of the Agreement. A separate license Agreement or additions to the present Agreement may be proposed by the Licensor. The acceptance of a new/amended Agreement if it has been proposed by the Licensor shall be a prerequisite for the prolongation of the validity of the right.
4.3 Other rights under this Agreement shall be granted for an indefinite period.
5. Procedure for termination of the Agreement
5.2 The Licensee may terminate the Agreement in case:
• If the Licensee does not receive the Program within 5 days after notification of the Licensor as regards payment (confirmation of payment). The Licensee shall retain this right until he receives the Program.
5.2 The Licensor may terminate the Agreement in case:
• If the Licensor fails to receive the payment under this Agreement to his bank account in time stipulated by items 2.2 and/or 3.1. The Licensor shall retain this right until he receives payment.
• If the Licensee breaches the contract in any other way
5.2 In case of termination of the Agreement:
• The Licensor shall return to the Licensee the payment that he has received at its account under the Agreement.
• The Licensee shall not have the right to use the Program and should immediately destroy all the copies of the Program made by it including backup copies.
6. Applicable Law
6.1 The present Agreement shall be regulated by the legislation of the Russian Federation. All disputes arising while fulfilling the present Agreement or in relation to it or arising out of it shall be settled in the international Commercial Arbitration Court under the Chamber of Commerce and Industry of the Russian Federation.
7. Waiver of Guarantee
7.1 The Program shall be granted on “as is” terms. The Licensor shall not provide any guarantee as regards faultless and uninterrupted operation of the Program, correspondence of the Program to specific goals and expectations of the Licensee, and shall not provide any guarantee that are not expressly specified in the present License. The Licensor shall not be liable for any direct or indirect consequences of any use or impossibility of using the Program and/or damage caused to the Licensee and/or third parties as a result of any use or non-use of the Program including those due to possible errors or malfunctions of the Program functioning to the maximum extent allowed by the applicable legislation.
8. Miscellaneous
8.1 In case any provision of the present Agreement shall be held invalid by the competent Court the remaining provisions shall continue in full force and effect.

Они заключили дополнительное соглашение к контракту № 020/MP-HDM/2010 от 05.04.20010 года (далее по тексту - Контракт) о нижеследующем:
1. Изложить п.3.1 в новой редакции:

3. Пункт 6.5 Контракта изложить в следующей редакции:
"Расходы на однократную поездку Покупателя и (или) его представителя к месту проведения тестовых испытаний в Республике Корея и обратно, а также расходы на проживание Покупателя и (или) его представителя в период проведения указанных испытаний в сумму контракта не входят и оплачиваются Покупателем самостоятельно.
4. Дополнить Контракт пунктом 6.6 следующего содержания:
" Продавец несет расходы по оплате перелетов Покупателя или его представителя авиарейсами регулярного пассажирского сообщения из города Москвы в Российской Федерации к месту проведения тестовых испытаний в городе Сеул в Республике Корея и обратно, а также несет расходы на оплату отеля для проживания Покупателя или его представителя в Республике Корея в период проведения указанных испытаний".
5. Настоящее соглашение является неотъемлемой частью контракта № 020/MP-HDM/2010 от 05.04.20010 года.

Система регистрации, анализа и мониторинга событий информационной безопасности (Система РАМС ИБ) представляет собой многоуровневую информационно-аналитическую систему, используемую для обеспечения постоянной защищенности автоматизированных информационных систем (АИС) как небольших организаций, так и распределенных систем государственного масштаба. Отличительной особенностью Системы РАМС ИБ является возможность контроля изолированных автоматизированных рабочих мест (АРМ) и локальных сетей, не включённых в информационные системы организации.
Под событиями информационной безопасности (СИБ) в АИС подразумеваются любые непредвиденные или нежелательные события, которые нарушают (или могут нарушить) требования информационной безопасности, а именно:
несанкционированное уничтожение и изменение информации;
несанкционированное блокирование средств, обеспечивающих доступ к информации;
создание нештатных режимов работы программных (программно-аппаратных) средств за счет преднамеренных изменений служебных данных и настроек;
несанкционированное копирование и распространение информации.
Система РАМС ИБ способна регистрировать следующие СИБ:
несоблюдение требований (политик) по обеспечению информационной безопасности (ИБ) при работе пользователей в АИС;
несанкционированное использование вычислительных ресурсов АИС;
нарушение правил доступа к объектам операционных систем (папки и файлы файловой системы, ключи реестра, запуск процессов, попытки записи информации на незарегистрированные флеш-диски и т.п.);
обнаружение компьютерных атак (КА) на вычислительные ресурсы АИС методами сигнатурного и поведенческого анализа (включая КА следующих типов: «отказ в обслуживании» (DoS), «распределённый отказ в обслуживании» (DDoS), «активность бот-сетей»);
перегрузка вычислительных ресурсов АИС, приводящая к невозможности функционирования заданных сервисов.

El sistema de registro, análisis y monitoreo de los eventos de la seguridad de la información (el Sistema RAME SI) es un sistema de información y análisis de múltiples niveles que se utiliza para garantizar la protección permanente de los sistemas automatizados de la información (SAI) tanto de compañías pequeñas, como de sistemas distribuidos de importancia nacional. Una característica distintiva del sistema RAME SI es su capacidad de supervisar los puestos de trabajo automatizados y aislados (PTA) y las redes locales no incluidas en los sistemas de la información de la compañía.
Entendemos como eventos de la seguridad de la información (ESI) en SAI a cualquier evento imprevisto o indeseable que viole (o pueda violar) los requisitos de la seguridad de la información, en particular:
Destrucción y modificación no autorizadas de la información;
Bloqueo no autorizado de los medios que proporcionan el acceso a la información;
Creación de modos de funcionamiento anómalos de software y hardware cambiando deliberadamente datos empresariales y configuraciones;
Copia y distribución no autorizada de la información.
El sistema RAME SI es capaz de registrar los siguientes ESI:
Incumplimiento de los requisitos (políticas) de la seguridad de la información (SI) cuando los usuarios usan los SAI;
Uso no autorizado de los recursos informáticos de los SAI;
Violación de las reglas de acceso a los elementos del sistema operativo (carpetas, archivos, claves de registro, inicialización de procesos, intentos de grabar información en unidades de memoria externas no registradas, etc.);
Detección de ataques informáticos (AI) sobre los recursos informáticos de los SAI con el método de firma y análisis de la conducta (incluyendo los AI de los siguientes tipos: “el ataque de denegación de servicio” (DoS por sus siglas en inglés), “el ataque de denegación de servicio distribuido” (DDoS por sus siglas en inglés), “la actividad de las botnets”);
Sobrecarga de los recursos informáticos de los SAI, que conlleva la imposibilidad de funcionamiento de los servicios especificados.
