Source text - German Die Anpassung der Miete kann jeweils mit Wlrkung vom 1. des Monats an verlangt werden, der auf den Monat der Indexänderung folgt. Entsprechendes gilt, wenn es erneut zu einer Veränderung des Verbrauchindexes gegenüber dem Stand zum Zeitpunkt der letzten Mletanpassung um mindestens 5 % kommt.
Die Änderung der Miete erfolgt durch schriftliche Erklärung. Diese muss auch die Änderung der nach der Mietanpassungsvereinbarung maßgebenden Preise nennen. Die dapn neu zu ermittelnde Miete ist ab dem übernächsten Monat nach der Abgabe der Erklärung zu zahlen. Ein Mietänderungsverlangen, das auf die Veränderung des Verbraucherpreisindexes gestützt ist, kann nur geltend gemacht werden, wenn die Miete mindestens 1 Jahr unverändert war
Translation - English The adjustment of the rent can be requested in each case with effective from the 1st of the month following the month of the index change. The same shall apply if there is again a change in the consumption index by at least 5% compared to the level at the time of the last rent adjustment.
The change in the rent shall be made by written declaration. This must also mention the change in the prices applicable under the Rent Adjustment Agreement. The revised rent to be recalculated shall be paid from the month after the month following the submission of the declaration. A rent change demand that is based on the change in the consumer price index shall only be claimed if the rent was not changed for at least 1 year.
