Source text - Spanish ACUERDO por el que se modifica la denominación y diversas disposiciones del "Acuerdo por el que se reconocen como equivalentes los requisitos establecidos en los artículos 161 Bis, 167, 169, 170 y 177 del Reglamento de Insumos para la Salud y a los procedimientos de evaluación técnica realizados por la Comisión Federal para la Protección contra Riesgos Sanitarios para el otorgamiento del registro sanitario de los insumos para la salud a que se refieren los artículos 2o., fracciones XIV, XV, incisos b y c y 166, fracciones I, II y III del Reglamento de Insumos para la Salud; en relación con los artículos 222 y 229 de la Ley General de Salud, los requisitos solicitados y procedimientos de evaluación realizados; así como la importación de medicamentos con o sin registro sanitario en México, dirigido a cualquier enfermedad o padecimiento, que estén autorizados por las siguientes autoridades reguladoras: Agencia Suiza para Productos Terapéuticos-Swissmed, Comisión Europea, Administración de Alimentos y Medicamentos de los Estados Unidos de América, Ministerio de Salud de Canadá, Administración de Productos Terapéuticos de Australia, Agencias Reguladoras de Referencia OPS/OMS; precalificados por el Programa de Precalificación para Medicamentos y Vacunas de la Organización Mundial de la Salud o Agencias Reguladoras miembros del Esquema de Cooperación de Inspección Farmacéutica", publicado el 28 de enero de 2020.

JORGE CARLOS ALCOCER VARELA, Secretario de Salud, con fundamento en los artículos 39, fracciones XV, XXI y XXVII de la Ley Orgánica de la Administración Pública Federal; 3o., fracción XXII, 4o., fracción III, 13, apartado A, fracción II, 17 bis, fracciones IV y VI, 194, último párrafo, 222, 229, 262 y 376 de la Ley General de Salud; 84, fracciones II y IV de la Ley General de Mejora Regulatoria; 2o., fracciones XIV y XV, incisos b y c, 132, fracciones I y II, 153, 161 Bis, 166, fracciones I, II y III, 167, 167Bis, 168, 169, 170, 177, 179 y 180 del Reglamento de Insumos para la Salud, así como 7, fracción XVI del Reglamento Interior dela Secretaría de Salud, y
CONSIDERANDO
Que conforme al artículo 17 bis de la Ley General de Salud, las atribuciones de regulación, control y fomento sanitario que corresponden a la Secretaría de Salud, conforme a la Ley Orgánica de la Administración Pública Federal, la Ley General de Salud y demás ordenamientos aplicables, entre las que se encuentra la de evaluar, expedir o revocar el registro sanitario de los insumos para la salud, son ejercidas a través de la Comisión Federal para la Protección contra Riesgos Sanitarios;
Que el párrafo último del artículo 194 de la Ley General de Salud, señala que el control sanitario del proceso, importación y exportación de medicamentos, estupefacientes y substancias psicotrópicas y las materias primas que intervienen en su elaboración, compete en forma exclusiva a la Secretaría de Salud, en función del potencial de riesgo para la salud que estos productos representan;
Que en términos de lo dispuesto por los artículos 204 y 376 de la Ley General de Salud, los medicamentos y demás insumos para la salud, requieren para su venta o suministro en el país, contar con la autorización sanitaria correspondiente, misma que adopta la modalidad de registro sanitario;
Que el artículo 222 de la Ley General de Salud, dispone que la Secretaría de Salud sólo concederá la autorización correspondiente a los medicamentos, cuando se demuestre que éstos, sus procesos de producción y las sustancias que contengan reúnen las características de seguridad, eficacia y calidad exigidas, que cumplen con lo establecido en esa Ley y demás disposiciones generales aplicables, para lo cual, la Secretaría de Salud o sus terceros autorizados, previamente deberán verificar el cumplimiento de las buenas prácticas de fabricación y del proceso de producción del medicamento, así como la certificación de sus principios activos;
Que el artículo 161 Bis del Reglamento de Insumos para la Salud establece que la Secretaría de Salud podrá expedir disposiciones de carácter general que tengan por objeto reconocer que los requisitos, procedimientos de evaluación y demás requerimientos solicitados por las autoridades sanitarias extranjeras para permitir en sus respectivos países la venta, distribución y uso de los insumos a que se refiere dicho Reglamento, son equivalentes a los que la Ley General de Salud, el propio Reglamento de Insumos para la Salud y demás disposiciones aplicables exigen para garantizar la calidad, seguridad y eficacia que deben satisfacer dichos productos para obtener su registro sanitario en el país;
Que el artículo 2o. del Reglamento de Insumos para la Salud define en su fracción XV a la molécula nueva como la sustanciade origen natural o sintético que es el principio activo de un medicamento, no utilizada previamente en nuestro país, cuya eficacia, seguridad y fines terapéuticos no han sido completamente documentados en la literatura científica. Encontrándose dentro de su clasificación, de conformidad con el inciso b de esta fracción, el fármaco o medicamento que aun existiendo en otros países, con experiencia clínica limitada o información controvertida, no tiene registro en México y pretende registrarse en nuestro país;
Que el artículo 2o. del Reglamento de Insumos para la Salud define en su fracción XIV al medicamento genérico como la especialidad farmacéutica con el mismo fármaco o sustancia activa y forma farmacéutica, con igual concentración o potencia, que utiliza la misma vía de administración y que mediante las pruebas reglamentarias requeridas, ha comprobado que sus especificaciones farmacopéicas, perfiles de disolución o su biodisponibilidad u otros parámetros, según sea el caso, son equivalentes a las del medicamento de referencia;
Que el artículo 166, fracciones I, II y III del Reglamento de Insumos para la Salud permite la expedición del registro sanitario de medicamentos alopáticos cuyos ingredientes activos no estén registrados en los Estados Unidos Mexicanos, pero se encuentren registrados y se vendan libremente en su país de origen; y que demostraron seguridad, eficacia y calidad;
Translation - English AGREEMENT which modifies the denomination and several provisions of the “Agreement recognizing as equivalent the requirements established in articles 161 Bis, 167, 169, 170, and 177 of the Health Supplies Regulation and the technical evaluation procedures performed by the Federal Commission for Protection against Sanitary Risks for granting the sanitary registration for the health supplies mentioned in articles 2, sections XIV, XV, subsections b and c, and 166, sections I, II, and III of the Health Supplies Regulation; with respect to articles 222 and 229 of the General Health Law, the requirements requested and the evaluation procedures performed; as well as the importation of drug products with or without a sanitary registration in Mexico, intended for any illness or health condition, authorized by the following regulatory authorities: Swiss Agency for Therapeutic Products-Swissmed, European Commission, United States of America Food and Drug Administration, Canada Health Ministry, Australian Therapeutic Goods Administration, Regulatory Agencies referenced by the PAHO/WHO; prequalified under the Drug Product and Vaccine Prequalification Program of the World Health Administration or Regulatory Agencies with membership in the Pharmaceutical Cooperation Inspection Scheme”, published on January 28, 2020.

WHEREAS
According to article 17 bis of the General Health Law, the powers of health regulation, control, and advancement corresponding to the Secretariat of Health, according to the Organic Law of the Federal Public Administration, the General Health Law, and other applicable ordinances, including the power to evaluate, issue, or revoke sanitary registrations for health supplies, are exercised through the Federal Commission for Protection against Sanitary Risks;
According to the last paragraph of article 194 of the General Health Law, the health control relating to the processing, importation, and exportation of drug products, narcotics, and psychotropic substances, as well as raw materials involved in their manufacture, correspond exclusively to the Secretariat of Health, by virtue of the potential health risks associated with these products;
According to the terms of articles 204 and 376 of the General Health Law, in order for drug products and other health supplies to be sold or supplied in the country, they must have the relevant sanitary authorization, in the form of a sanitary registration;
According to article 222 of the General Health Law, the Secretariat of Health shall only grant the relevant authorization to drug products when they, their production processes, and the substances they contain are proven to meet the obligatory safety, efficacy, and quality characteristics, in compliance with the provisions of the General Health Law and other applicable general provisions, for which reason the Secretariat of Health or authorized third parties shall previously verify compliance with the Good Manufacturing Practices and appropriate drug product production process, as well as the certification of its active substances;
According to article 161 Bis of the Health Supplies Regulation, the Secretariat of Health may issue general provisions intended to recognize that the requirements, evaluation procedures, and other requirements requested by foreign sanitary authorities to permit, in their own countries, the sale, distribution, and use of the supplies referred to in said Regulation, are equivalent to those that the General Health Law, the Health Supplies Regulation, and other applicable provisions require to guarantee the quality, safety, and efficacy said products must demonstrate in order to obtain a sanitary registration in the country;
According to article 2, section XV, of the Health Supplies Regulation, a new molecule is defined as a substance of natural or synthetic origin which is the active substance of a drug product, previously unused in our country, whose efficacy, safety, and therapeutic purposes have not been fully documented in the scientific literature. Drugs or drug products meeting this classification, according to subsection b of this section, are those which exist in other countries, with limited clinical experience or controversial information, but are not registered in Mexico and for which a sanitary registration is sought;
According to article 2, section XIV, of the Health Supplies Regulation, generic drug products are defined as a pharmaceutical product with the same drug or active substance and dosage form, with the same concentration or potency, using the same route of administration, and which, through the required regulatory tests, has been proven to have equivalent compendial specifications, dissolution profiles, or bioavailability, among other parameters, as the case may be, to the reference drug product;
According to article 166, sections I, II, and III, of the Health Supplies Regulations, sanitary registrations for allopathic drug products with active ingredients not registered in the United Mexican States, but registered and sold over-the-counter in their country/countries of origin; and which exhibit safety, efficacy, and quality, are authorized to be issued;
