Source text - Portuguese Antes de adentrar ao mérito da consulta, nos cumpre explanar que, em que pese a legislação trabalhista e a jurisprudência dos Tribunais Brasileiros tenham evoluído nos últimos anos com relação à flexibilização de terceirização de atividade fim, a prática da “pejotização”, assim entendida como a contratação de empregado, via pessoa jurídica, visando à redução de custos para ambas as Partes, dentro os quais se destacam os recolhimentos de encargos trabalhistas, previdenciários e fiscais, embora cada vez mais frequente no cotidiano das relações de trabalho, ainda é expressamente vedada pela legislação e veementemente preterida pela Justiça do Trabalho, relevando-se como fraude (art. 9º da CLT ) e, inclusive, crime (Art. 203 do Código Penal ).
Translation - English Before delving into the counseling’s merit, we must disclose that despite the labor legislation and the Brazilian Case Laws have evolved in recent years regarding the flexibility of outsourcing of the businesses’ core activities, the practice of hiring individuals as "legal entities", thus understood as the hiring of an employee, through a legal entity, aiming to reduce costs for both Parties, among which the collection of labor, social security, and tax charges, although increasingly frequent in the daily life of labor relationships, is still expressly prohibited by the legislation and vehemently reviewed by the Labor Courts, considering them as fraud (art. 9 of the CLT ) and even crime (Art. 203 of the Penal Code).
