Source text - English The Anteriority of the Signing of the standing volume sales orders in relation to the provisional concession decree
According to Article 73 of Law No. 94/01 of 20 January 1994 on the forestry, wildlife and fisheries regime, supplemented by Articles 110 and 111 of Decree No. 95/531 of 23 August 1995, in the event of the implementation of a development project likely to cause the destruction of part of the national forest estate, or in the event of a natural disaster with similar consequences, the administration in charge of forestry shall carry out a salvage logging operation, either by management or by the sale of the timber concerned. In addition, this salvage logging must comply with a certain number of procedures contained in Articles 81 et seq. of the above-mentioned decree. Thus, the orders signed by the Minister of Forestry on 16 February 2022 fall into the category of salvage logging sales. They are attributed "as part of the implementation of a development project in the national domain" resulting from "the implementation of the XXX SA palm grove extension project. The reasons for the attribution of these decrees are clearly linked to the project of setting up an agro-industrial complex by XXX company.
Furthermore, on 7 March 2022, the President of the Republic signed a provisional concession decree for XXX company over an area of 39,923 hectares, thus giving the company the right or authorisation to set up operations in the field. However, the orders for the sale of timber for the "extension of XXX SA palm groves" were signed by the Minister of Forestry and Wildlife on 16 February 2022, well before the provisional concession decree signed by the President of the Republic on 7 March 2022.
Clearly, the Minister of Forestry violated the law by signing the orders for the allocation of timber sales. At the time of signing, there was no legally recognised development project in the area. In other words, the legal basis for the timber sales did not yet exist. He simply put the cart before the horse, because he could not know before that time whether or not the President of the Republic would grant this space to XXX or even what area should be allocated to this company.
Translation - French L'antériorité de la signature des ordres de vente de volumes permanents par rapport au décret de concession provisoire
Selon l'article 73 de la loi n° 94/01 du 20 janvier 1994 portant régime des forêts, de la faune et de la pêche, complété par les articles 110 et 111 du décret n° 95/531 du 23 août 1995, en cas de réalisation d'un projet d'aménagement susceptible d'entraîner la destruction d'une partie du domaine forestier national, ou en cas de catastrophe naturelle ayant des conséquences similaires, l'administration chargée des forêts procède à une exploitation forestière de sauvetage, soit par aménagement, soit par vente des bois concernés. En outre, cette exploitation de sauvetage doit respecter un certain nombre de procédures contenues dans les articles 81 et suivants du décret précité. Ainsi, les arrêtés signés par le ministre des forêts le 16 février 2022 entrent dans la catégorie des ventes de coupes de sauvetage. ls sont attribués " dans le cadre de la mise en œuvre d'un projet de développement du domaine national " résultant de " la mise en œuvre du projet d'extension de la palmeraie XXX SA ". Les raisons de l'attribution de ces arrêtés sont clairement liées au projet d'implantation d'un complexe agro-industriel par la société XXX.
Par ailleurs, le 7 mars 2022, le Président de la République a signé un décret de concession provisoire au profit de la société XXX sur une superficie de 39 923 hectares, donnant ainsi à la société le droit ou l'autorisation de s'installer sur le terrain. Or, les arrêtés de vente de bois pour " l'extension de la palmeraie de XXX SA " ont été signés par le ministre des forêts et de la faune le 16 février 2022, bien avant le décret de concession provisoire signé par le président de la République le 7 mars 2022.
De toute évidence, le ministre des Forêts a violé la loi en signant les arrêtés d'attribution des ventes de bois. Au moment de la signature, il n'y avait aucun projet de développement légalement reconnu dans la zone. En d'autres termes, la base légale pour les ventes de bois n'existait pas encore. Il a tout simplement mis la charrue avant les bœufs, car il ne pouvait pas savoir avant cette date si le Président de la République accorderait ou non cet espace à XXX ou même quelle surface devait être attribuée à cette société.
