Source text - French Le droit pénal ou droit criminel est la branche du droit qui détermine des comportements antisociaux (les infractions), et prévoit la réaction de la société envers ces comportements, le plus souvent sous forme d'une peine pénale.
Le droit pénal concerne le rapport entre la société en général et un individu.
Il est souvent opposé au droit civil, qui concerne les rapports entre deux personnes morales ou physiques.
Il s'articule avec les règles de procédure pénale, qui fixent le cadre juridique que doivent respecter l'enquête, la poursuite et le jugement visant une personne soupçonnée d'avoir commis une infraction.
D'un point de vue juridique, le droit pénal est fréquemment divisé en deux grands ensembles :
Le droit pénal général, qui précise les conditions générales d'incrimination et de fixation des peines, réservées au pouvoir législatif ou réglementaire.
Le droit pénal spécial, qui établit un catalogue de comportements incriminés : les infractions.
Translation - English Criminal Law is the branch of law that identifies anti-social behaviour (offences), and provides for society's response to such behaviour, usually in the form of a criminal penalty.
Criminal Law deals with the relationship between society in general and an individual.
It is often contrasted with Civil Law, which deals with the relationships between two legal entities or individuals.
It is linked to the rules of criminal procedure, which set out the legal framework for the investigation, prosecution and trial of a person suspected of having committed an offence.
From a legal standpoint, Criminal Law is often divided into two main areas :
General Criminal Law, which sets out the general conditions for prosecution and sentencing, reserved for legislative or regulatory authorities.
Special Criminal Law, which establishes a catalogue of criminal behaviour : offences.
