Source text - English 3. OBLIGATIONS OF THE CONTRACTING PARTY
3.1 General Provisions
3.1.1 Thorough Knowledge of the Contract Documents
(1) The Contracting Party shall thoroughly examine the Contract Documents, including all administrative and technical documents, to avoid any mistakes or misinterpretations.
(2) If necessary, the Contracting Party shall request clarification from the Principal about any provisions that should have been included in the Contracting Party’s opinion, or that the Contracting Party considers to be ambiguous, unclear or vague.
(3) Under no circumstance may the Contracting Party invoke any mistake, ambiguity or lack of clarity in the Contract Documents, nor any misunderstanding on its part, to claim an extension of the Schedule or a change in price. No representation or warranty, express or implied, is made and no responsibility of any kind is accepted by the Principal or its advisors, employees, consultants or agents, for the completeness or accuracy of any information contained in the Contract Documents, or provided to the Contracting Party during the procurement process or during the term of the Agreement. The Principal and its advisors, employees, consultants and agents shall not be liable to any person or entity as a result of the use of any information contained in the Contract Documents or provided to the Contracting Party during the procurement process or during the term of the Agreement.
Translation - Romanian 3. OBLIGAŢIILE PĂRŢII CONTRACTANTE
3.1 Prevederi generale
3.1.1 Cunoaşterea aprofundată a Documentaţiei Contractuale.
(1) Partea Contractantă va examina cu atenţie Documentaţia Contractuală, inclusiv toată documentaţia administrativă şi tehnică, pentru a evita orice greşeală sau interpretare greşită.
(2) Dacă este nevoie, Partea Contractantă va solicita clarificarea de către Mandant a oricăror prevederi care ar fi trebuit incluse după părerea Părţii Contractante, sau care sunt considerate a fi ambigue , neclare sau vagi.
(3) Partea Contractantă nu poate acuza sub nici o formă vreo eroare, ambiguitate sau lipsă de claritate a Documentaţiei Tehnice, sau orice interpretare greşită din partea acesteia, pentru a cere o prelungire a Orarului sau o modificare a preţului. Nu se va face nici o reprezentare sau garantare, în mod expres sau implicit, şi nu se va accepta nici un fel de responsabilitate de către Mandant sau de către consilierii, angajaţii, consultanţii sau agenţii acestuia, în ceea ce priveşte caracterul complet sau acurateţea oricărei informaţii conţinute în Documentaţia contractuală, sau furnizate părţii contractante pe perioada procesului de achiziţie sau pe perioada prezentului Contract.
