Source text - Russian Федеральное государственное бюджетное учреждение «российский онкологический научный центр имени Н.Н.Блохина» Российской академии медицинских наук (ФГБУ «РОНЦ им. Н.Н.Блохина» РАМН), именуемый в дальнейшем «Принимающая сторона», в лице Директора XXXXXXX., действующего на основании Устава, с одной стороны, и BILD hilft e.V. “Ein Herz für Kinder”, именуемая в дальнейшем «Передающая сторона», с другой стороны, в лице госпожи XXXXXX, заключили настоящий договор о ниже следующем: 1. Предмет договора 1.1. По настоящему договору Передающая сторона обязуется передать в качестве добровольного пожертвования, а Принимающая сторона принять денежные средства в сумме 14 000 (четырнадцать тысяч) евро. 2. Сроки и иные условия 2.1. Добровольное пожертвование в виде передачи денежных средств по данному договору осуществляется в срок до «___»______________ 2014 г. 2.2. Передача денежных средств осуществляется путем их перечисления на расчетный счет «Принимающей стороны» или внесения их в кассу Принимающей стороны. 2.3. Принимающая сторона гарантирует использование денежных средств для лечения пациента XXXXXXX (23.06.2009 г.р.) в ФГБУ «РОНЦ им. Н.Н.Блохина» РАМН (Приложение № 1 к договору – по необходимости) и обязуется предоставить, по письменному требованию Передающей стороны, отчет о целевом использовании принятых денежных средств. 3. Форс-мажор 3.1. Стороны освобождаются от ответственности за невыполнение обязательств по настоящему Договору в случае, если это невыполнение вызвано форс-мажорными обстоятельствами, которые признаются по действующему законодательству. В этом случае установленные сроки выполнения обязательств, указанных в Договоре, переносятся на срок, в течение которого действуют форс-мажорные обстоятельства. 3.2. Сторона, для которой создалась невозможность исполнения обязательств по Договору, обязана известить в письменной форме другую сторону о наступлении и прекращении вышеуказанных обстоятельств не позднее десяти дней с момента их наступления. 3.3. Если эти обстоятельства будут длиться более четырех месяцев, стороны встретятся, чтобы обсудить, какие меры следует принять. Однако, если в течение последующих двух месяцев стороны не смогут договориться, тогда каждая из сторон вправе аннулировать Договор при условии, что стороны вернут друг другу все материальные и денежные активы, полученные ими в связи с действием настоящего Договора. 4. Расторжение договора, споры и разногласия. 4.1.Передающая сторона может отказаться от передачи, а Принимающая сторона от принятия при условии, что другая сторона, будет не позднее, чем за 30 дней до установленной даты передачи, письменно предупреждена о расторжении настоящего договора. 4.2. Все споры и разногласия между сторонами разрешаются в установленном законом порядке в Арбитражном суде г. Москвы. 4.3. Стороны обязуются отвечать на претензии исходящие из выполнения настоящего договора в срок не более 10 дней. If a Force Majeoure lasts longer than four months both Parties are to meet to discuss further actions. Termination of the Contract and disputes 4.1. Disclosing Party may refuse the monetary donation and the Receiving Party may deny the conditions of this Contract. In such a case either of the Parties must notify the other Party about the discontinuation of this Contract no later than thirty days before the monetary donation is scheduled to occur. 4.2. All disputes between the Parties will be resolved in accordance with the Law at the Moscow Arbitration Court. 4.3. The Parties are obligated to respond to all disputes regarding the conditions of this Contract within ten days.
