თავი I
ზოგადი დებულებები
მუხლი 1. კოდექსის მოქმედების სფერო
მაუწყებელთა ქცევის კოდექსი (შემდგომში ”კოდექსი”) მიღებულია საქართველოს კომუნიკაციების ეროვნული კომისიის მიერ ”მაუწყებლობის შესახებ” საქართველოს კანონის შესაბამისად და განსაზღვრავს მაუწყებლის მიერ პროგრამის მომზადებისა და გადაცემის პრინციპებს, წესებსა და სახელმძღვანელო რეკომენდაციებს.
მუხლი 2. სამართლებრივი საფუძვლები
1. ამ კოდექსის სამართლებრივი საფუძველია საქართველოს კონსტიტუცია, მაუწყებლობის მარეგულირებელი საერთაშორისო ხელშეკრულებები, მაუწყებლობის შესახებ” საქართველოს კანონი, ”საქართველოს საარჩევნო კოდექსი”, ”საავტორო და მომიჯნავე უფლებების შესახებ” საქართველოს კანონი, სიტყვისა და გამოხატვის თავისუფლების შესახებ სხვა საკანონმდებლო აქტები.
2. მაუწყებლობის პრინციპები განსაზღვრავს მაუწყებლის პროფესიულ სტანდარტებს თავისუფალ, პლურალისტურ და დემოკრატიულ სახელმწიფოში და სავალდებულოა შესასრულებლად.
3. წესები განსაზღვრავს კოდექსის მოთხოვნებს, რომლებიც დაცული უნდა იქნას მაუწყებლის მიერ ამ კოდექსით გათვალისწინებული ამოცანების შესასრულებლად.
4. სახელმძღვანელო რეკომენდაციები არის არასავალდებულო ხასიათის მეთოდური მითითებები (ხერხები და საშუალებები), რომელთა გამოყენებით მაუწყებელს შეუძლია დაიცვას ამ კოდექსით დადგენილი პრინციპები და წესები. ჟურნალისტების, რედაქციებისა და მაუწყებლების დახმარება სამაუწყებლო საქმიანობის პროცესში წარმოშობილი ეთიკური საკითხების გადაწყვეტაში, საყოველთაოდ აღიარებული პროფესიული სტანდარტების შესაბამისად და ყველა ლეგიტიმური ინტერესის გათვალისწინებით. ეს რეკომენდაციები ეხმარება მაუწყებლებს, საქართველოში ყველა ლიცენზირებული მაუწყებლის მომსახურების წესების, პირობების, ეთიკური ნორმებისა და პროფესიული სტანდარტების განსაზღვრასა და გაუმჯობესებაში; სახელმძღვანელო რეკომენდაციები ასევე ეხმარება ჟურნალისტებს, რედაქტორებს და მაუწყებელს სამაუწყებლო საქმიანობის პროცესში წარმოშობილი ეთიკური საკითხების გადაწყვეტაში, საყოველთაოდ აღიარებული პროფესიული სტანდარტების შესაბამისად.
5. კოდექსის ინტერპრეტირება უნდა მოხდეს საქართველოს კონსტიტუციის, ადამიანის უფლებათა და ძირითად თავისუფლებათა ევროპული კონვენციისა და ადამიანის უფლებათა ევროპული სასამართლოს პრეცედენტული სამართლის შესაბამისად ისე, რომ სიტყვისა და გამოხატვის თავისუფლება მაქსიმალურად ხელშეუხებელი იყოს.
მუხლი 3. კოდექსის პრინციპები
1. კოდექსი ეყრდნობა შემდეგ სამაუწყებლო პრინციპებს
ა) მიუკერძოებელობა და ზუსტი ინფორმაციის უზრუნველყოფა , სიტყვისა და გამოხატვის თავისუფლება, ჟურნალისტთა პროფესიული თავისუფლება, სარედაქციო დამოუკიდებლობა და საზოგადოებრივი ანგარიშვალდებულება, საინფორმაციო და სამოქალაქო საზოგადოების ჩამოყალიბების ხელშეწყობა.
ბ) სხვადასხვა სოციალური ჯგუფის ინტერესების გათვალისწინება განურჩევლად მათი პოლიტიკური, კულტურული, ეთნიკური, რელიგიური, რეგიონული, ენობრივი, ასაკობრივი თუ გენდერული კუთვნილებისა.
გ) პირადი ცხოვრების ხელშეუხებლობის პატივისცემის უზრუნველყოფა, გამოხატვის თავისუფლების უზრუნველყოფა საზოგადოებრივ ინტერესსა და პირადი ცხოვრების ხელშეუხებლობის პრინციპებს შორის ბალანსის დაცვის საფუძველზე.
დ) თვითრეგულირების ფარგლებში საჩივრის განხილვისა და გადაწყვეტის პროცედურების განსაზღვრა.
2. კოდექსის გამოყენებისას მაუწყებელმა უნდა გაითვალისწინოს გამოქყვეყნებული მასალის კონტექსტი და მხედველობაში მიიღოს შემდეგი გარემოებები:
ა) მოსალოდნელი ზიანისა და შეურაცხყოფის მიყენების ხარისხი, რომელიც შესაძლებელია მოახდინოს პროგრამაში გარკვეული შინაარსის მასალის გამოყენებამ.
ბ) სავარაუდო აუდიტორიის სიდიდე და შემადგენლობა.
გ) სავარაუდო აუდიტორიის მოლოდინი კონკრეტული პროგრამის მიმართ, პროგრამის შესახებ აუდიტორიის ინფორმირების შესაძლებლობა და სავარაუდო აუდიტორიაზე პროგრამის შესაძლო ზემოქმედება.
დ) პროგრამის შინაარსობრივ ნაწილზე სარედაქციო დამოუკიდებლობის და პასუხისმგებლობის შენარჩუნების მნიშვნელობა.
3. კოდექსის ნორმები, მათი შინაარსის გათვალისწინებით, ვრცელდება მაუწყებელის მიერ ვებგვერდზე განთავსებულ მასალებზეც.
მუხლი 4. კოდექსის მიზანი
1. კოდექსის მიზანია, ყველა სახის მაუწყებელი განსაკუთრებით კი საზოგადოებრივი მაუწყებელი თანაბარი პასუხისმგებლობით მოეკიდოს პროფესიული ეთიკის ნორმების დაცვასა და საზოგადოების წინაშე ანგარიშვალდებულებას, რაც აუცილებელია დემოკრატიულ საზოგადოებაში ზნეობისა და ადამიანური ღირებულებების დასაცავად, საზოგადოებრივი თანხმობისა და ტოლერანტობის განსამტკიცებლად.
2. იმ შემთხვევაში თუ მაუწყებელი დაარღვევს ამ კოდექსით განსაზღვრულ წესებს, იგი ვალდებულია აღნიშნული ქმედება დაასაბუთოს განსაკუთრებული საზოგადოებრივი ინტერესით, გონივრული საფუძვლებით და მოახდინოს სარედაქციო პროცესის ნათლად და მკაფიოდ დემონსტრირებას კოდექსის პრინციპების შესაბამისად.
მუხლი 5. ტერმინთა განმარტება
ამ კოდექსის მიზნებისათვის მასში გამოყენებულ ტერმინებს აქვთ შემდეგი მნიშვნელობა:
ა) ანტისოციალური ქცევა - საზოგადოებაში მიღებული სოციალური ნორმების საწინააღნდეგო ქცევა.
ბ) ახლო ხედი - ადამიანის (პერსონაჟის) სრული გამოსახულება ანტურაჟის გარეშე ან სხეულის ცალკეული ნაწილის გამოსახულება;
გ) ბრენდი - სავაჭრო ნიშანი გამოსახურლი ან დაბეჭდილი ყუთზე, კოლოფსა და პაკეტებზე. საქონლის, პროდუქტის განსაკუთრებული სახეობა ამ ნიშნით.
დ) ბრენდინგი - პროდუქტისადმი ხანგრძლივი უპირატესობის მინიჭების შემქმნელი აქტივობა, რომელიც ეფუძნება მარკეტინგული კომუნიკაციის ყველა სახის (უწინარესად პიარი და რეკლამა) და სხვა ელემენტების (შეფუთვა და სამარკო ნიშანი) მომხმარებლის ცნობიერებაზე ერთობლივ ზემოქმედებას.
ე) გამართლებული ქმედება – საზოგადოების ინტერესებიდან გამომდინარე ამ კოდექსით დადგენილი წესების შეუსრულებლობის ისეთი იშვიათი შემთხვევა, როდესაც დაცული სიკეთე აღემატება ზიანს და მაუწყებელს შეუძლია მოთხოვნის შეუსრულებლობის რედაქციულად დასაბუთება.
ვ) დაინტერესებული მხარე - ნებისმიერი პირი, რომელსაც ეხება ან რომელიც ნახსენებია პროგრამაში ან მაუწყებლის თვითრეგულირების ორგანოს გადაწყვეტილებაში.
ზ) დორსტეპინგი - ეთერში განთავსების მიზნით ინტერვიუს ან სატელეფონო საუბრის ჩაწერა წინასწარი გაფრთხილების გარეშე. დორსტეპინგის წესები არ გამოიყენება შემთხვევითი შერჩევის პრინციპით საზოგადოებრივი აზრის გამოკითხვაზე.
თ) ეგზორციზმი - ფსიქიკური დარღვევების მკურნალობაში შელოცვის მეთოდების გამოყენება ავადმყოფის სხეულში თითქოსდა ჩასახლებული ეშმაკის განდევნის მიზნით, რომელმაც ავადმყოფში შეიძლება გამოიწვიოს ფსიქიკური აშლილობა.
Translation - English Media Code of Conduct
Part I
General Provisions
Article 1. Scope of activity
Media code of conduct (hereinafter “code”) is enacted by the Georgian national committee of communications in accordance with the Georgian law “Regarding Media” and outlines the standards of program preparation and reporting by the media, its rules, and recommended guidelines.
Article 2. Legal grounds
Legal grounds of the hereby code is Georgian Constitution, international regulatory agreements regarding media, Georgian law “Regarding Media”, “Georgian Electoral Code”, Georgian law “Regarding Copy rights and miscellaneous rights”, and other legal acts regarding freedom of speech and the freedom of expression.
2. Media standards outline the standards of media professional conduct in a free, pluralistic, and democratic society and are necessary for implementation.
3. Rules determine the requirements of the code that need to be followed by the media to meet the goals outlined in the hereby code.
4. The recommended guidelines are not requirements; they only represent methodical suggestions (methods and choices) and, if implemented, media can satisfy the rules and standard of professional conduct outlined in the hereby rules. They can help journalists, publishing companies, and other media to solve emerging ethical problems by using the accepted guidelines on standards of professional conduct to protect all legal interests. These recommendations help media determine and improve upon all rules, conditions, ethical norms, and professional standards for every licensed media service provider in Georgia; the recommended guidelines will also help journalists, editors, and the members of the media solve ethical problems which may arise in the media and will enable them to act according to the accepted professional standards.
5. The interpretation of the code must be made according to the Georgian Constitution, European Convention on human rights and fundamental freedom, and on the grounds of the precedence on human rights laws implemented by the European courts in order to ensure the protection of freedom of speech and freedom of expression.
Article 3. Standards of the Code
1. The hereby code is based on the following media standards:
a) To provide impartiality and accurate information; to protect freedom of speech and freedom of expression; to protect journalists’ professional freedom; to preserve independence of media and make it accountable before public; to facilitate the formation of the informed civil society.
b) To protect interests of various social groups regardless of their political, cultural, ethnic, religious, and regional backgrounds, as well their language, age, and gender.
c) To respect individuals’ rights to privacy; protect freedom of expression and balance between individuals’ right to privacy and public’s right to know.
d) To determine procedures regarding claim review and make decisions based on the principles of self-regulation.
2. When applying the hereby code, media must take into the consideration the context of the published material and the following:
a) The amount of potential damage and embarrassment which can be caused by the context of the publication material.
b) The size and the composition of the potential audience;
c) Expectations of the potential audience regarding a specific program; knowledge of the potential audience regarding the topic of the program, and potential impact on the audience by the program;
d) Media’s editorial freedom to choose the context of the programming and the importance of such freedom, as well as the media’s public accountability.
3. Norms of the code and its context also apply to the information published and/or covered on the web pages.
Article 4. The purpose of the Code
1. The purpose of the code is to guarantee media’s, especially public media’s full responsibility to protect professional codes of ethics and maintain public accountability; such actions are necessary in order to protect dignity and personal values in the democratic society in order to strengthen tolerance and peaceful coexistence of people.
2. If any norms of the hereby code is violated, media must justify such violation by public interest, provide reasoned explanations for such violations both, vividly and accurately, and refer to the relevant rules from the code as legal grounds of the violation.
Article 5. Explanation of Terms
The terms used in the hereby code have the following meanings for the purposes of the code:
a) Anti-social behavior – Behavior contrary to the social norms accepted in the society.
b) Close view (close captioning) – A full view of a person (character), or the image of different parts of the body without an entourage;
c) Brand – Trademark embossed or printed on a box and kits, indicating special type of goods or products by imprinting such trademark on them;
d) Branding – Ascribing a special longer durability power to the specific product by means of utilizing all types of marketing communication tools (primarily PR and commercials, etc.) which are used in combination in order to influence costumers’ opinions by implementing various methods (packaging and labeling).
e) Justified action – Violation of the rules established by the hereby code that are justified by public interest; such rare events when benefits outweigh harm and when media is able to provide an editorial justification for its non-compliance.
f) Interested party – any person, who is named in the program, or in the decision of the self-regulated media, and who is affected by the programming.
g). Door stepping – Recording of an interview or a phone conversation without prior warning for the purposes of its publication by media. The rules of door stepping are not used in random public surveys.
h) Exorcism – Using prayers for mentally sick patients in order to exorcise devil spirits from the patient’s body, which allegedly causes psychological disturbance to the patient.
