"Tax Indemnification: The parties during their marriage filed joint income tax returns through the year. Each of the parties represent to the other that the information furnished in connection with the preparation anf filing of all past joint tax returns is correct to the best of their knowledge. Each party desires and indemnification from the other as it **pertains to the other party's misreporting or at fault** in such joint income tax returns. Therefore, if one party is responsible for either: (1) non-reporting of any income in any fashion or (2) misreporting deductions or (3) other activity that may cause the joint tax return to be audited by any government agency wherein penalties, assessments, additional taxes to be due, each party agrees as follows:"
