Die Widerklage ist eine Klage, die vom Beklagten im gleichen Verfahren gegen den Kläger erhoben wird.
Die Voraussetzungen der Widerklage sind:
Die Klage muss im Zeitpunkt der Erhebung der Widerklage rechtshängig sein.
