Un evento drammatico movimentò i lavori parlamentari della Commissione: Manes morì per infarto nell'anticamera di palazzo San Macuto, mentre aspettava di essere ascoltato da Alessi che lo aveva convocato in seduta segreta nel 1969. Le due borse di documenti che aveva con sé sparirono, ma, quando De Lorenzo querelò Eugenio Scalfari e Lino Jannuzzi, estensori degli articoli de L'Espresso sul caso, il pubblico ministero Vittorio Occorsio ne chiese l'assoluzione proprio in ragione delle parti del rapporto Manes contenute in quelle borse ed a lui misteriosamente pervenute: si trattava degli incartamenti integrali, come risultanti dal testo di Manes prima che il governo li rendesse inutili con gli "omissis". Nonostante la richiesta del pubblico ministero, comunque, Scalfari e Jannuzzi furono condannati per diffamazione
