The (contracting) parties are agreed that the down-payment can be kept as cancellation fee. can be kept = this clause would apply only in case of cancellation so "can be" is the shortest formulation a long version would be: The (contracting) parties are agreed that in case of cancellation by the buyer the down-payment will be kept as cancellation fee. kapara = partial advance payment made to secure the conclusion of a contract - refundable if the refund is asked within certain rules fixed by law or the specific contract. odustatnina = penalty to be paid for changing your mind and cancelling the contract here "kapara" is equated to "odustatnina" in plain English if: if you change your mind and cancel the contract, what you have paid in advance (kapara) will not be returned to you but kept as penalty (odustatnina).
