the doctrine of unclean hands

Hi!

I would really appreciate if someone could tell me if s/he has a French equivalent for the "doctrine of unclean hands".
Here's the context :
the court upheld the decision to dismiss the case, ruling that the doctrine of unclean hands did not bar the defendant art gallery’s laches defense.

yes I mean Catherine is right, and you are right too (I've had a look to the link http://www.icj-cij.org/docket/files/90/5143.pdf and it's written in French "doctrine des mains propres", which is the same as "doctrine des mains sales"

According to Garner (Dictionary of Modern Legal Usage, p 116), the "clean hands" doctrine is the same as "unclean hands" (as well it must be), so why not translate your phrase accordingly ? "Doctrine des mains propres" is sufficiently attested in ghits ..

je pense que c'est un concept si étranger à la F qu'il faut laisser le terme as is... ou alors on se lance ds personnes avec des antécédants (judiciaires) ou dont le témoignage est suspect, non fiable etc et on s'en sortira pas ou mal... je serais vraiment tentée de laisser "mains sales", peut-être entre guillemets, autrement on va transposer à côté de la plaque... Bon je me trompe sûrement, mais je ferais ça si confrontée au pb:)

neutral Michael GREEN : Comme la "clean hands doctrine" est la même chose, juridiquement, que la "doctrine of unclean hands" , je ne pense pas qu'il soit nécessaire de chercher plus loin que "la doctrine des mains propres" (ou des mains sales")
