Zgodnie z ogólną myślą ustawodawcy, wynikającą z art. 108 kodeksu cywilnego, stosunki prawne z samym sobą, zakładające przeciwstawność stron, są dozwolone tylko wówczas, gdy wyłączona jest możliwość naruszenia interesów mocodawcy, jeżeli to on występuje osobiście po jednej stronie, a po drugiej jest reprezentowany. Jeżeli stosunek prawny nawiązywany jest w imieniu mocodawcy przez pełnomocnika, będącego jego drugą stroną (do takiej sytuacji wprost odnosi się art. 108 k. c. ), to dopuszczalność *** czynności prawnej z samym sobą*** może wynikać także z treści pełnomocnictwa.
