Source text - Serbian Izvođenje šipova prečnika Ø1200cm, podrazumeva korišćenje adekvatne oprema za bušenje koja zahteva veću širinu i veći stepen zbijenosti platoa. Prvobitnom metodologijom Izvođača koja je rađena na osnovu Glavnog projekta, predviđeno je bušenje šipova na zidu XX sa postojećeg magistralnog puta za šta je obezbeđen projekat saobraćajne signalizacije i obustava saobraćaja na jednoj strani puta. Međutim, usled povećanja prečnika šipova na zidu XX i dodatkom šipova istog prečnika na zidu XX, dimenzije i gabariti mašine za bušenje šipova uslovili su neophodnost izrade privrmenog nasipa. U slučaju izrade šipova sa magistrale, bilo bi neophodno potpuno obustavti saobraćaj što nije dozvoljeno Ugovorom. Dinamika bušenja, kao i izvođenje šipova, odvija se po unapred utvrđenom redosledu koji podrazumeva korišćenje dve bušeće garniture koje paralelno izvode radove sa početka/kraja zida prema sredini. Nakon betonaže šipova, pristupa se izradi veznih greda iznad šipova čime se formira potporna konstrukcija magistralnog puta na potezu od km xxxxxxx do km xxxxxxxx.
Prilikom izvođenja šipova, potrebno je voditi računa o položajima propusta koji su predmet posebnog projekta Regulacije vodotokova.
Translation - English Construction of piles with a diameter Ø1200cmm requires the engagement of adequate boring equipment that requires a wider area and a higher degree of compaction of the platform. The initial Contractor’s methodology, prepared based on the Main Design, envisaged boring of piles for the wall XX from the existing state road, for which the Design of Traffic and Traffic Signalization as well as suspension of traffic on one side of the road were obtained. However, due to the increase of pile diameter on the wall XX and addition of piles of the same diameter on the wall XX, dimensions and size of pile boring machine conditioned the necessity of construction of the temporary platform. In case the piles had been constructed from the state road, it would have been necessary to completely suspend the traffic, which is not allowed under the Contract. Boring schedule, as well as execution of piles, take place according to a predetermined sequence that involves engagement of two boring sets, which would execute the works simultaneously, from the beginning/end of the wall towards the middle. Upon concreting of piles commences the construction of tie beams above the piles, which serve to form the retaining structure for the state road, on the section from km XXXXXX to km XXXXXX.
During execution of piles, it is necessary to take into consideration the position of culverts, that are the subject of a separate Design of Regulation of Watercourses.

Source text - English A. Nomination of Subcontractors
The Subcontractor may hire his subcontractors for part of the works, on which he shall inform the Engineer, the Employer XXXXX and the Main Contractor, and receive the consent from the Employer XXXXXX. The Subcontractor shall submit the nomination in written form to the Engineer and the Employer XXXXXX, which shall contain the following documentation:
a) Decision on registration of the business entity at the Business Registers Agency;
b) Memorandum of Association;
c) Confirmation that the legal entity has not been prohibited from performing activities, issued by the Business Registers Agency;
d) Certificate on settled liabilities based on public revenues;
e) Annual balance sheet for the previous year;
f) Report on creditworthiness for public procurements;
g) References for activities for which the subcontractor is being nominated;
h) Data on resources.
B. Variation Procedure
In case the Subcontractor proposes a Variation in accordance with the conditions on the terrain, the Subcontractor shall submit the Proposal of the Variation to the Engineer, the Employer XXXXX and the Main Contractor.
Proposal of the Variation shall contain:
a) description of the Variation;
b) Bill of Quantities for those works which are the subject of the Variation;
c) price breakdown for all work items;
d) Schedule of Works;
e) technical documentation.
Upon providing approval of the submitted Proposal of the Variation, the Engineer shall submit a written notification to the Employer XXXXX, the Subcontractor and the Main Contractor, with the request for recording of Costs. The Proposal of the Variation shall be considered accepted upon approval of the unit prices for those work items which are the subject of the Variation, by the Engineer and the Employer XXXXXXX.
C. Issuance of bank security for the deposit on behalf of guarantee of the quality of executed works
The amount of 10% of the total contracted value of the works shall be retained to the Subcontractor, until expiration of the guarantee period. The Subcontractor may replace the deposit on behalf of the guarantee of quality of executed works with the bank security, until expiration of the guarantee period. For refund of the deposit on behalf of the guarantee of quality of executed works, the Subcontractor shall submit to the Employer a Payment Certificate for payment of the deposit on behalf of the guarantee of quality of executed works, with the bank security issued on behalf of the Main Contractor. During the guarantee period the Main Contractor cannot enforce the bank security for the deposit on behalf of the guarantee of quality of executed works without prior consent of the Employer XXXXXXX. The Main Contractor shall return the original of the bank security for the deposit on behalf of the guarantee of quality of executed works to the Subcontractor within 7 (seven) days after expiration of the guarantee period.
On request of the Main Contractor, and as instructed by the Employer XXXXX, the Subcontractor shall, during the guarantee period, remedy the subsequently observed defects on executed works which are the subject of this Contract.

Podizvođač može da za deo radova angažuje svoje podizvođače, o čemu je dužan da obavesti Inženjera, Investitora XXXXXXX i Glavnog Izvođača, i dobije saglasnost Investitora XXXXXXX. Podizvođač je dužan da Inženjeru i Investitoru XXXXXXX dostavi nominaciju u pisanoj formi, koja će sadržati sledeću dokumentaciju:
a) Rešenje o registraciji privrednog subjekta u Agenciji za privredne registre;
b) Odluku o osnivanju privrednog društva;
c) Potvrdu Agenicije za privredne registre da privrednom subjektu nije izrečena mera zabrane obavljanja delatnosti;
d) Uverenje o izmirenju dospele obaveze javnih prihoda;
e) Godišnji bilans za prethodnu godinu;
f) Izveštaj o bonitetu za javne nabavke;
g) Reference za poslove za koje se podizvođač nominuje;
h) Podatke o resursima.
B. Procedura Izmene
U slučaju da Podizvođač predlaže Izmenu u skladu sa uslovima na terenu, Podizvođač je dužan da predlog Izmene dostavi Inženjeru, Investitoru XXXXX i Glavnom Izvođaču.
Predlog Izmene će sadržati:
a) opis izmene;
b) predmer i predračun radova koji su predmet Izmene;
c) analize cena svih pozicija radova;
d) dinamiku radova;
e) tehničku dokumentaciju.
Po davanju saglasnosti na dostavljeni Predlog Izmene, Inženjer će dostaviti pisano obaveštenje Investitoru XXXXXX, Podizvođaču i Glavnom Izvođaču, sa zahtevom da se evidentiraju Troškovi. Predlog Izmene će se smatrati konačno prihvaćenim po odobrenju jediničnih cena od strane Inženjera i Investitora XXXX, za one pozicije radova koje su predmet Izmene.
C. Izdavanje bankarske garancije za depozit na ime kvaliteta izvedenih radova
Do isteka garantnog perioda Podizvođaču se zadržava 10% od ukupne ugovorene vrednosti radova. Podizvođač može da zameni depozit na ime kvaliteta izvedenih radova bankarskom garancijom, do isteka garantnog perioda. Za povraćaj depozita na ime kvaliteta izvedenih radova Podizvođač će Investitoru dostaviti Situaciju za isplatu depozita na ime kvaliteta izvedenih radova, uz garanciju banke izdatu na ime Glavnog Izvođača radova. U toku garantnog perioda Glavni Izvođač ne može aktivirati garanciju za depozit na ime kvaliteta izvedenih radova, bez prethodnog odobrenja Investitora XXXXX. Glavni Izvođač je dužan da u roku od 7 (sedam) dana nakon isteka garantnog perioda vrati original bankarske garancije za depozit na ime kvaliteta izvedenih radova Podizvođaču.
Na poziv Glavnog Izvođača, a prema zahtevu Investitora XXXX, Podizvođač je dužan da za vreme trajanja garantnog perioda otkloni naknadno uočene nedostatke na izvedenim radovima koji su predmet ovog ugovora.
