English to Spanish: Civil Procedure General field: Law/Patents Detailed field: Law (general)
Source text - English An action is commenced by two writings, a complaint and a summons. The complaint is a statement which sets out the nature of the plaintiff´s claim and his demand for relief. The summons is a notice of informing the defendant that an action is being brought against him and calling upon him to answer the compliant. In order to meet the constitutional requirement of due process, service of the summons must be by a means which is reasonably designed to give the defendant notice. Ordinarily it is delivered to him personally or left with an appropriate person at his residence or place of business within the geographical jurisdiction of the court. The defendant then commonly enters an appearance by filing a paper, known as answer, which is responsive to the complaint; if he does not appear a default judgment may be entered against him.
