Statement regarding the authorisation of a UCITS fund by the CBoI:

"The authorisation of the Funds by the Central Bank shall not constitute a warranty as to the performance of the Funds and the Central Bank shall not be liable for the performance or *default* of the Funds."

In this context, "Funds" denotes sub-funds established under an umbrella fund.

Note that I'm not looking for a literal translation of the word "default" - it's the cross-reference with an investment fund that bugs me: I wouldn't normally expect an investment fund to default?

Nichtleistung

Soweit ich das verstanden habe, Ralf, übernimmt die Zentralbank keine Haftung für die Erbringung der (möglicher Weise versprochenen) Leistung des Fonds, noch für das Ausbleiben dieser Leistung, also für die Nichtleistung. Der Ausdruck "Nichtleistung" stammt aus einer Reihe von Suchergebnissen. Vielleicht gibt es da aber einen noch spezifischern Terminus technicus. "Nichterbringung der Leistung" wäre z.B. eine andere Möglichkeit. Es geht sicher noch eleganter.

Gegenfrage: Warum sollte ein Investment-Fond nicht in der Lage sein, eine (versprochene) Leistung nicht zu erbringen? Ich finde, es gibt doch zahlreiche Beispiele dafür.

Verschulden / Schlechterfüllung / Nichterfüllung der Verpflichtungen

whether you would expect a fund to default or not is really of little consequence here: I think somebody is trying to cover his/her backside by covering all eventualities. Therefore, we are back to translating default.

Zahlungsunfähigkeit

Ralf,

an investment fund can be held liable and has to mention the possibility of a default in its prospectus

agree Steffen Pollex (X) : I was up to "Bankrott", too which is basicly the same but "Zahlungsunfähigkeit" sounds better. I couldn't see what bugs you Ralf.
