Talvez o protesto não seja tão usado, nos EUA, porque muitos títulos já trazem em seus termos uma renúncia ao protesto, como este (do meu último exemplo):

All parties to this note waive presentment, notice of non-payment, protest and notice of protest, and agree to remain fully bound notwithstanding the release of any party, extension or modification of terms, or discharge of any collateral for this note.

Assim, ante tal renúncia, o credor vai direto ao Juiz na ação de cobrança. Mas a figura do protesto existe, nos EUA, como se pode ver dos dois exemplos que apresentei (o primeiro e o último) e pela confirmação dos colegas.
