Over the course of this litigation, I have noticed a pattern of potential judicial bias, where all my motions are being denied while all defendants' motions are granted. I have two cases in litigation. The referral judge is the same in both cases, but different presiding judges. In the first case, there was one motion the referral judge granted and then at a later date withdrew in light of the presiding judge's order for me to show cause, which subsequently led to the case dismissal, appeal thru the 10th circuit and now SCOTUS. The second case in the meantime had been stayed, but the other presiding judge allowed it to resume last summer. Ever since the second case resumed, the referral judge has denied every motion I filed, (with the exception of motion for extension of time, which he granted), while granting every motion defendant filed to date. The same referral judge was also a mediator in our ADR process. He just recently denied my motion for leave to file amended complaint (and motion for reconsideration) and also motion to compel, while granting defendants motion to compel. Am I able to now file an appeal, or file a ****motion for bias**** and to disqualify the judge or should I simply file a complaint with the judicial council?

Later, Ball again moved for the return of the seized property, arguing that the district court had jurisdiction. After the government reminded the court that it had denied the previous *****motion for lack of jurisdiction*****, the court entered an order denying Ball's ****motion for lack of jurisdiction**** and ordering the clerk of court not to accept further motions for return of property. -
