I believe operar in this case means "to be valid" or "to enter into effect".

DRAE - operar 3. intr. Dicho de una cosa: Producir el efecto para el cual se destina.

Counsel is stating that the assignment of rights to his client was validly made while the assignor was alive.

Alternatively:
