Den 8. juni 2010 modtog vi en ansøgning fra børnenes moster xxx om at få tillagt forældremyndigheden. Ansøgningen var vedlagt kopi af et børnetestamente, udfærdiget 15. marts 2010, hvor det fremgik, at afdøde xxx udtrykte ønske om, at xxx ikke skulle tillægges forældremyndigheden over børnene.

On the basis of the following from Hans's link, I now agree with Sven:
"Rent juridisk stilles der ingen krav om, at en sådan erklæring - der noget misvisende kaldes for et børnetestamente - skal oprettes på en bestemt måde. I kan derfor nedskrive jeres tilkendegivelse på et stykke ganske almindeligt papir, som I daterer og underskriver. Derefter er dokumentet gyldigt, og børnetestamentet bør opbevares et sted, hvor det efter al sandsynlighed bliver fundet i tilfælde af jeres død, fx sammen med jeres bankbøger og andre private papirer."
In other words, the formalities of a will need not be observed, if this source is correct. It would most likely be wrong to refer to this declaration as a will, under these circumstances.

"Appointment" is the standard English term, in both the U.K. and the U.S., whether it's done by the testator's will or another means. "Declaration" is an alternative that is sometimes used. The source plainly refers to a will, not a declaration generally.
