In der Gemeinschaftsordnung werden die Rechte und Pflichten der Miteigentüner bezügl. gemeinschaftseigentums geregelt. Die Gemeinschaftsordnung ist mit dem Miteigentum untrennbar verbunden, ist Teil des bzw. definiert das Miteigentum in seiner konkreten Ausgestaltung. Eine Übertragung des Miteigentums ohne die Rechte und Pflichten aus der Gemeinschaftsordnung ist naturgemäß nicht möglich.
