"defend" is not redundant here Explanation: The duty to "defend" relates to claims by third parties arising from the contract. The inclusion of the word "defend" means that the Company has a duty to intervene on the Contractor's behalf in the event of a third party claim. -------------------------------------------------- Note added at 1 day5 hrs (2009-05-25 08:25:01 GMT) -------------------------------------------------- I don't think that this could possibly apply to physical injury cases (where statute law would apply), only to monetary claims for non-performance, non-supply, failure to employ the services of a third party etc. -------------------------------------------------- Note added at 1 day5 hrs (2009-05-25 08:30:24 GMT) -------------------------------------------------- I think that the purpose of including "defend" here is probably to ensure that, in the event of a Contractor incurring a third party claim, the Company doesn't simply say that the matter is none of its business and that the Contractor and third party should just get on with sorting it out between themselves. |
