Hi everyone,

I am having a hard time to translate "necessary claims". The text is a contract, the subject matter is intellectual property and this term appears in the definitions.

Here is one definition of "necessary claims": "Those claims under patents and/or patent applications anywhere in the world that would be Necessarily Infringed by the implementation of a Required Element(s) of a Standard."

I could find it in many documents in English but no clue how to translate it in French. My only guess would be "plainte pour contrefaçon de brevet", which seems inaccurate to me - there's definitely something missing.

Dans ce contexte "patent claim": "revendication du brevet" (étendue de sa protection) et non plainte.

Les "Necessary Claims" sont donc les revendications ("parties" de la définition de l'objet du brevet)qui seront nécessairement/forcément contrefaites du fait de la mise en oeuvre de xxx

Asker: Well the exact quotation from my contract is: " 'Necessay claims' means that a patent claim is necessarily infringed for purposes of this Consortium Agreement but only when it is not possible to avoid infringing it because there is no plausible non-infringing alternative for implementing the relevant portions of specifications related to interoperability."
