English term

with liberty to restore

English to French Law/Patents Law (general) Divorce
Here is the sentence:
"Household contents and/or personal chattels shall be divided between (sic) agreement between the parties, with liberty to restore in default of agreement."
Does this mean that there is the possibility of restoring the household contents and/or personal chattels?

Discussion

Thank you very much for your help. It is appreciated.
AllegroTrans Mar 23, 2007:
As this an application for an order, "interjeter appel" (I agree this sounds better) would be a suitable translation - i.e. there will be an order when the application is granted!!
AllegroTrans Mar 23, 2007:
Hello again. "avec droit de recours auprès du tribunal" would definitely be a suitable translation. I assume the wording is part of an application for a Court order. If this is so and the order is granted then "liberty to restore" will be part of it
Jacqueline Kent (asker) Mar 23, 2007:
I would rather agree with AllegroTrans. The only problem is "interjeter demande" which is not a recognized term. "Interjeter appel" would be used, but this would imply that there already has been a court order, which is not the case. The contents and chattels are first divided by agreement between the parties. If they cannot agree, they can go to court. Would "avec droit de recours auprès du tribunal" be appropriate? Thank you very much for your help.
AllegroTrans Mar 22, 2007:
This refers to the right to restore the matter to Court - i.e. to make a further application to the Court - see my suggester answer
Jacqueline Kent (asker) Mar 22, 2007:
Oui, il s'agit d'un divorce. J'ai donc traduit "in default of agreement" par "à défaut d'accord". Il n'y a bien sûr pas de contrat. J'avais d'ailleurs traduit "with liberty to restore" par "avec possibilité de restitution", mais cette traduction n'est appropriée que si "restore" se rapporte aux "household contents and/or personal chattels".
BusterK Mar 22, 2007:
