This is the title of a Swiss legal document concerning a mortgage note but I'm not quite sure how the mortgage note fits in with the "droit de gage immobilier" or how to translate "acte constitutif" in this context.
Can "acte constitutif d'un droit de gage immobilier" just be translated as "mortgage deed" or is this not specific enough?

1. Beware of Eurodicautom's 'right of lien' for droit de gage - there is no such thing. It#s either a lien, pedge or right to create such.
2. FHS Bridge F/E glossary -> droit de gage immobilier = real security; CHARGE ON REAL PROPERTY [but a fixed charge can be over fixed asssets gen. i.e. land, plant & equipment].
3. Unusual set-up if right. As this Google ref. says, debentures are usually secured by a floating and not a fixed charge.
4. Mortgage deed refers to land only. A charge certificate is issued by a UK Land Registry. If it's a chattel mortgage i.e. of a motor car, it's called a Bill of Sale.

Lien in GB can be of goods or chattels only - not of fixed assets like land when it turns into a charge.
Note that a co. can, by its Articles, claim an automatic \'lien\' on its members\' shares for unpaid calls. Shareholders individually can \'charge\' their shares by \'mortgaging\' them to a lender.

there are three kinds of cedule hypothecaire:
au porteur
nominatif
and au nom du proprietaire...
acte constitutif just means the document..a droit de gage is a possessory real property lien...
I think this a LIEN on a MORTGAGE......if that is possible...not just a straight mortage......
